RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF A PORTION OF LUGO AVENUE, BETWEEN 4TH STREET AND
5TH STREET AND RESERVING EASEMENTS FOR PUBLIC UTILITIES AND SANITARY SEWER
THEREIN.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1.
That the Mayor and Common Council of the City of San
Bernardino hereby declares its intention to order the vacation of a
portion of Lugo Avenue, between 4th Street and 5th Street, described as
follows:
That portion of Lugo Avenue, 50 feet wide, as shown on
map of the Amended Baldridge Subdivision, in the City of
San Bernardino, County of San Bernardino, State of
California, as per map recorded in Book 17 of Maps, page
38, records of said County, described as follows:
Beginning at a point on the East line of said Lugo
Avenue, said point being Southerly thereon a distance of
122.53 feet from the Northwest corner of Lot 23 of said
Amended Baldridge Subdivision, said point also being the
beginning of a non-tangent curve concave to the
Northeast and having a radius of 47.00 feet, a radial
line from said point bears North 030 39' 35" West; thence
Westerly and Northerly, along said curve, through a
central angle of 930 39' 35", a distance of 76.83 feet to
the West line of said Lugo Avenue; thence South, along
said West 1 ine, a distance of 315.94 feet to the
Southeast corner of Lot 4 of said Amended Baldridge
Subdivision; thence North 890 56' East, a distance of
50.00 feet to the Southwest corner of Lot 3 of said
Amended Baldridge Subdivision, said point also being the
East line of said Lugo Avenue; thence North, along said
East line, a distance of 268.98 feet, more or less, to
the Point of Beginning.
SECTION 2.
That the Mayor and Common Council of the City of San
Bernardino, in vacating the above described portion of said street ,elects
to proceed under and in accordance with the provisions of Chapter 3 of
the "Public Streets, Highways and Service Easements Vacation Law", being
Division 9, Part 3, of the Streets and Highways Code of the State of
California.

SECTION 3.
That the hour of 10:00 A.M. on Monday, the 16th
2 day of July, 1990 . in the Council Chamber of the City Hall, San
3 Bernardino, California, be, and the same hereby is fixed as the time and
4 place when and where all persons interested in or objecting to the proposed
5 vacation may appear before the said Mayor and Common Council and offer
evidence
in relation thereto.
For further particulars as to the proposed

vacation
of the hereinbefore described portion of said street, reference is
8 made to that map marked "Plan No. 7531" approved September 9. 1989, on
9 file in the office of the City Clerk of said City.

SECTION 4. Nothing in this Resolution shall in any way affect
11 or disturb any existing easements for sanitary sewer and appurtenant
12 facilities and for public utility purposes belonging either to the
13 City of San Bernardino or to any public utility and there is hereby
14 reserved for future general public utility purposes and for this City an
easement
reasonably necessary to locate such sanitary sewer and public
15

utility facilities over. in,
under
or
across the real property
17 hereinabove described and to use, maintain, repair, replace or renew
18 such facilities and there is hereby specifically reserved, easements for
19 General Telephone and Southern California Edison to construct. place,
20 operate, inspect. maintain, repair, replace and remove such aerial and
21 underground telephone, telegraph and communication structures and electrical
22 transmission structures respectively, as the companies may from time to time
23 require, consisting of poles, anchors, wires, cables, conduits, manholes.
24 markers and necessary fixtures and appurtenances.
25 SECTION 5. That the City Engineer of the City of San Bernardino
26 hereby is directed to cause Notices of Street Vacation to be posted as
27 required by the Public Streets, Highways and Services Vacation Law.

SECTION 6. That the City Clerk shall certify to the adoption of

this Resolution of Intention and shall cause the same to be published once a
week for two successive weeks in The Sun, a newspaper published and
circulated in the City of San Bernardino, prior to the date of the above
public hearing.
