Home My WebLink About1990-206 RESOLUTION NO. 90-206 1 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COSTS 2 OF ABATEMENT OF PUBLIC NUISANCES AND IMPOSING LIENS ON CERTAIN REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE 3 COSTS OF THE ABATEMENT 4 5 6 7 WHEREAS, the San Bernardino, to its City of pursuant author i ty under Chapter 8.27 Bernardino Municipal of the San ode, did lawfully cause public nuisances to be abated on the roperties described in Exhibit "An attached to and incorporated 8 in this resolution; and 9 10 11 12 13 14 15 16 17 18 19 20 21 WHEREAS, notice was given to the owners of record of said roperties, and a hearing has heretofore been held to hear rotests and assess the costs of said abatement before the Board f Building Commissioners. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON OUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Said costs are found to have been incurred by he City pursuant to proceedings under the San Bernardino lunicipal Code, and the final statement of costs on file with he City Clerk is hereby confirmed and adopted as special ssessments against the properties listed in Exhibit "A" hereto. SECTION 2. If said sum is not fully paid to the City lerk, City San Bernardino, within five (5) days after Hall, 22 ailing a notice to the person or persons of the adoption of 23 his resolution as to any such 24 individual parcel, then said sum hall be and becoltle a lien on said property pursuant to said 25 unicipal Code provisions and applicable laws and shall be 26 27 28 ollected as a special assessment thereon. SECTION 3. In the event any sum is not paid as ereinabove provided, the City Clerk is hereby directed to file 05-15-90 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 a certified copy of this resolution, including Exhibit "A" showing such sums as remain unpaid, with the Recorder and the Auditor of the County of San Bernardino, State of California, irecting that each sum be entered as a lien charged against the roperty as it appears on the current assessment rolls, to be ollected at the said time and in the same manner, subject to he same penalties and interest upon delinquencies, as the eneral taxes for the City of San Bernardino are collected. PENMAN Ci ty At torney Byff~ 1 Pe--- 3 ORDER NO. 1382 1 ORDER OF THE BOARD OF BUILDING CO~lISSIONERS OF THE CITY 2 OF SAN BERNARDINO ASSESSING COSTS OF ABATEMENT OF PUBLIC NUISANCE 3 4 Title 8, WHEREAS, pursuant to the San Bernardino Hunicipal Code, Chapter 8.27, the Director of Public Services of the 5 City of San Bernardino has given notice of and thereafter abated 6 a public nuisance found to exist 7 8 on the properties described in Exhibit "A" attached to and hereby incorporated in this order; and 9 10 Director of Public Services served notice to WHEREAS, pursuant to San Bernardino Municipal Code, the all property owners 11 listed in Exhibit "A", of the hearing before the Board of 12 Building Commissioners of the City of San Bernardino relating to 13 abatement costs to be assessed the owners and their right to 14 appear at said hearing and protest the assessments; and 15 16 has WHEREAS, every property owner against whom an assessment been proposed has been afforded an opportunity to be heard by 17 the Board of Building Commissioners heretofore; 18 19 CITY OF SAN BERNARDINO ORDERS THE FOLLOWING: NOW, THEREFORE, THE BOARD OF BUILDING COMMISSIONERS OF THE 20 1. Based upon the evidence submitted by the Director of 21 Public Services or his representative, it is found and determined 22 that the properties described in Exhibit "An, conE,jtuted a public 23 nuisance which had to be abated by the City at the costs stated 24 in 25 26 Exhibit "A". 2. These costs should be assessed in the amounts set forth in Exhibit "A" against the respective properties and may be 27 made a personal obligation of the 28 property owner by commencement of court proceedings against the owner. 3. Any person ag9 r ieved by this order may appeal to the 1 2 3 4 5 6 7 Common Council by filing with the City Clerk a written statement of the order appealed from, the specific ground of appeal and the relief or action sought from the Common Council pursuant to the San Bernardino Municipal Code.
