HomeMy WebLinkAbout1990-174 " ,I ~ 04/30/90 . 1 90-174 RESOLUTION NO. 2 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF 5TB STREET BETWEEN DALLAS AVENUE AND 3 MERIDIAN AVENUE, AND RESERVING AN EASEMENT FOR SANITARY SEWER AND APPURTENANT FACILITIES THEREIN. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 5 BERNARDINO AS FOLLOWS: 6 7 SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of 8 a portion of 5th Street between Dallas Avenue and Meridian Avenue 9 described as follows: 10 All that portion of Fifth Street, as shown on Parcel Map No. 2320, as per plat recorded in Book 20 of Parcel Maps, 11 Page 70, in the office of the County Recorder of San Bernardino County, described as follows: 12 13 14 15 16 17 18 19 20 Commencing at the Northeast corner of said Parcel No.2; thence South 00 02' 22" East along the East line of said Parcel No.2, a distance of 148.00 feet to its intersection with the North line of said Fifth Street and the True Point of Beginning; thence South along the East line of said 5th Street, a distance of 56.00 feet to the South line thereof; thence South 890 49' 20" West along said South line, a distance of 165.00 feet to the West line of said Parcel No.2; thence North 00 02' 22" West along the West line of said 5th Street, a distance of 56.00 feet to the North line thereof; thence North 890 49' 20" East along said North line, a distance of 165.00 feet to the True Point of Beginning. SECTION 2. That the Mayor and Common Council of the City of San 21 Bernardino, in vacating the above described portion of said streets, elects 22 to proceed under and in accordance with the provisions of the "Public 23 Streets, Highways and Services Vacation Law", being Division 9, Part 3, of 24 the Streets and Highways Code of the State of California. 25 SECTION 3. For further particulars as to the proposed vacation of the hereinbefore described portion of said streets, reference is made to that map marked "Plan No. 7966" approved December 4, 1989, on file in the office of the City Clerk of said City. SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing easements for sanitary sewer and appurtenant facilities or any easement for public utility purposes belonging either to the City of San Bernardino or to any public utility, and there is hereby reserved for this City an easement reasonably necessary to locate such sanitary sewer facilities in, over, under, or across the real property hereinabove described and to use, maintain, repair, replace or renew such facilities. SECTION 5. That the City Engineer of the City of San Bernardino hereby is directed to cause Notices of Street Vacation to be posted as required by the Public Streets, Highways and Services Vacation Law. SECTION 6.
