RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO J.J. ROOFING FOR REPLACING THE ROOF FOR THE CITY HALL
ANNEX (THRIFTY BUILDING) .
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. J. J. Roofing is the lowest responsible bidder
for replacing the roof for the City Hall Annex (Thrifty
Building), at 245 North "E" Street, in accordance with Plan No.
8,074, for the Basic Bid in the amount of $33,495.00, and a
contract is awarded to said bidder accordingly, but such award
shall be effective only upon the contract being fully executed by
the parties; all other bids therefore are hereby rejected; and
the Mayor is hereby authorized and directed to execute said
contract on behalf of the City; a copy of the contract is
attached hereto, marked Exhibit" A" and incorporated herein by
reference as fully as though set forth at length.
SECTION 2.
This contract and any amendment or modi fica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral
amendments,
agreements,
modifications
or wai vers
are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3.
This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.

NOTICE IS HEREBY GIVEN that the City of San Bernardino will
receive bids or proposals for:
ROOF REPLACEMENT OF CITY HALL
ACCORDANCE WITH SPECIAL PROVISIONS
THE OFFICE OF THE CITY ENGINEER.
ANNEX BUILDING IN
NO. 8074, ON FILE IN
Deliver all bids to the City Engineer's Office, 3rd floor, City
Hall, 300 North "0" Street, San Bernardino, California, with the
Specification title and number clearly marked on the outside of
the envelope.
Said bids or proposals will be received up to the hour of 2:00
p.m., on AP~,L 17 , 1990, at which time all of said bidsor
proposal s Wl be publ i cl y opened, exami ned and decl ared in the
City Engineer's Conference Room, third floor, City Hall.
No bi d wi 11 be recei ved unl ess it is made on a proposal form
furnished by the City. All bids or proposals shall be signed,
sealed and accompanied by cash, cashier's check, certified check
or bid bond made payable to the City of San Bernardino, in the
amount of ten percent (10%) of the bid. Such cash, check or bond
shall be given as a guarantee that the bidder will enter into the
contract if awarded to him. In the event the bidder refuses to
execute said contract, the use by the pUblic of the improvements
will be delayed, and the public will suffer great damage. From
the nature of the case, it would be extremely difficult and
impractical to fix said amount of damages. Therefore, the City
and the bidder agree that the above sum of 10% shall be paid to
the City upon the condition above set forth as liquidated damages
and not as a forfeiture. All bonds furnished pursuant to this
notice must be underwritten by a surety company having a rating
in Best's most recent Insurance Guide of "A" or better.
Pursuant to law, the Mayor and Common Council of the City of San
Bernardino, by Resolution No. 12846 and any and all amendments
thereto whi ch are hereby referred to and made a part thereof by
references as fully as though set forth at length herein, have
ascerta i ned and determi ned the genera 1 pre va i 1 i ng rate of per
diem wages, and of per diem wages for legal holidays and overtime
work for each craft or type of workman needed in the execution of
contracts under jurisdiction of said Mayor and Common Council.
Said prevailing rates of wages shall conform to "General
Prevailing Wage Determination made by the Director of Industrial
Relations", filed in the Office of the City Clerk, which are made
a part of said Resolution No. 12846 and amendments thereto.

The Contractor may substitute securities for any monies
withheld by the Agency to ensure performance under the contract
as provi ded for in Secti on 2230 of the Cali forni a Government
Code and Section 10263 of the California Public Contract Code.
It shall be mandatory upon the Contractor to whom the contract
is awarded and upon any sub-contractor under him to pay not
less than said specified rates to all laborers, workmen, and
mechanics employed by them in the execution of the contract,
and to prevent discrimination in the employment of persons
because of race, creed, color, or national origin, as set forth

Common Council of the City of San Bernardino. .

be conducted on APRIL 10 , 1990, at 9:00 a.m. The review

All bidders are required to attend the pre-bid field review.
All bidders shall be pre-qualified prior to submitting a bid. Pre-
qualification shall consist of completing the Pre-qualification Form,
attached as Appendix "A", and submitting it to the Public Works
Department Office on the third floor of City Hall, seven (7) calendar
days prior to bid opening. These forms will be reviewed by the
Director of PUblic Works/City Engineer, whose decision shall be final.
No bid will be received from a bidder who has not been pre-qualified.

3. CONDITIONS:
The General Requirements and Recommendations in this manual shall apply to roofing specifications for all systems.
4. APPLICATION:
Install a single layer of fiberglass base sheet, Type G2 or equal, over entire roof deck. Overlap sides and ends of base sheet
3", and extend base sheet 2" past the cant and up the vertical wall 2~ mechanically attach the base sheet as per Section 3.01.
General Requirements.
5. MEMBRANE INSTALLATION:
Starting at the low point of the roof deck. install one layer of AMERIVAL APP 5 Membrane over the entire surface of the foof
deck following the procedures for Heat Welded Systems, Section 5.02 in the manual. Side laps shall be 4" and head laps 6~
6. MEMBRANE PROTECTION:
This specification requires membrane protection for warranty purposes. Suitable roof coating or other designated protection
must be used. Follow the coating manufacturers recommendations for application and/or special requirements. Consult the
AMERIVAL CORP. for specifics.
7. DETAILS:
See Section 7 of this manual for details for flashing pipes, corners, walls and terminations.

AMERIVAL APP membranes are roofing/waterproofing membranes composed of high quality bitumen modified
with atactic polypropylene (APP) resins and reinforced with a core of spun bonded polyester. This unique blend of
products allows the membranes to perform under extreme stress conditions, and still maintain their flexibility and
seam integrity.
The membranes are smooth surfaced, which allows many different selections for membrane protection such as
aluminum or white coating, tile, gravel, etc.

1-1.01 GENERAL -- The work embodied herein shall be done
in accordance with the Standard Specifications for Public Works
Construction, 1988 Edition, and City of San Bernardino Standard
Drawings. insofar as the same may apply and in accordance with
the following Special Provisions.

SECTION 2
2-1 PROPOSAL REQUIREMENTS AND CONDITIONS
2-1.01 GENERAL -- Bids must be submitted on the proposal
form contained herein. All bids or proposals shall be signed,
sealed and accompanied by cash, cashier's check, certified
check or bi d bond made payabl e to the Ci ty of San Bernardi no,
in the amount of ten percent (10%) of the bid. Such cash,
check or bond shall be given as a guarantee that the bidder
will enter into the contract, if awarded to him. In the event
the bidder, to whom the contract is awarded, refuses to execute
said contract, the use by the public of the improvements will
be delayed and the public will suffer great damage. From the
nature of the case, it would be extremely difficult and
impractical to fix said amount of damage. Therefore, the City
and the bidder agree that the proposal guarantee of 10% of the
bid shall be paid to the City upon the conditions set forth
above as liquidated damages and not as a forfeiture. Bid bonds
shall be underwritten by a surety company having a rating in
Best's most recent Insurance Guide of "A" or better.

SECTION 3
3-1 AWARD AND EXECUTION OF CONTRACT
3-1.01 GENERAL -- Award of the contract will normally be
made by the Mayor and Common Council at the subsequent Council
Meeti ng after openi ng of the bi ds. The bi dder, to whom the
contract is awarded. shall file with the Engineer all required
bonds and insurance policies, and execute the contract. within
10 calendar days after receiving notification of the
award. Failure to file the stipulated documents and execute
the contract within the prescribed time shall constitute good
and sufficient grounds for recession of the award and payment
of 10% of the bid to the City as liquidated damages.
3-1.02 CONTRACT BONDS The Payment and Faithful
Performance Bonds shall be fll ed wi th the Engi neer before the
contract is executed by the Ci ty in accordance wi th Secti on
2-4, .CONTRACT BONDS., of the Standard Specifications.

4-1 CONSTRUCTION SCHEDULE AND COMMENCEMENT OF WORK.

SECTION 5
5-1.01 LIABILITY INSURANCE -- The Contractor's attention
is directed to Section 7-3. "Liability Insurance". of the
Standard Specifications. providing that the Contractor shall
furnish the City with a policy of liability insurance as
prescribed therein. prior to execution of the contract. The
policy shall name the City of San Bernardino as additional
insured.
5-1.02 WORKMEN'S COMPENSATION INSURANCE The
Contractor's attention is directed to Section 7-4. "Workmen's
Compensati on Insurance", of the Standard Speci fi cati ons.
providing that the Contractor shall file a signed Certification
Certificate of Workmen's Compensation Insurance before
execution of the contract.
5-1.03 PAYMENT OF PREVAILING WAGE RATE -- The Contractor
and all subcontractors shall pay each craft or workman employed
on this project not less than the prevailing wage rates
speci fi ed in Resol uti on No. 12846 of the Mayor and Common
Council of the City of San Bernardino. The Engineer shall have
the right to interview any craft or workman on the project site
in order to verify payment of prevailing wage rates in
accordance with Resolution No. 12846.
5-1.04 PAYROLL RECORDS -- The Contractor's attention is
directed to the following provisions of Labor Code Section 1776
(Stated 1978. Ch. 1249). The Contractor shall be responsible
for the compliance with these provisions by his subcontractors.
(a) The Contractor and all subcontractors shall keep an
accurate payroll record showing the name, address. Social
Security Number. work classification. straight time and over-
time hours worked each day and week. and the actual per di em
wages paid to each journeyman, apprentice. worker. or other
employee employed by him or her in connection with the public
work.
(b) The payroll records enumerated under subdi vi si on (a)
shall be certified and shall be available for inspection at all
reasonable hours at the principal office of the Contractor on
the following basis:
(1) A certified copy of an employee's payroll record
shall be made avai 1 abl e for i nspecti on or furni shed to such
employee or his or her authorized representative on request.

(c) Each Contractor shall file a certified copy of the
records enumerated in subdivision (a) with the Engineer on a
weekly basis. It will be the Contractor's responsibility to
submit the records enumerated in subdivision (a) for all of his
subcontractors, in addition to his own employees. Failure to
submit the records enumerated in subdivision (a) on a timely
basis shall constitute good and sufficient reason for
withholding the partial payments for work accomplished.
5-1.05 OISCRIMINATION/AFFIRMATIVE ACTION CLAUSE
Contractor hereby certifies that it will not discriminate
agai nst any employee or appl i cant for employment because of
race, color, religion, sex, martial status or national origin.
Contractor shall promote affirmative action in its hiring
practices and employee policies for minorities and other
designated classes in accordance with Federal, State and Local
laws. Such action shall include, but not be limited to, the
foll owi ng: Recruitment and recrui tment adverti si ng, employ-
ment' upgrading, and promotion. In addition, Contractor shall
not exclude from participation under this Agreement any
employee or appl icant for employment on the basis of age,
handicap or religion in compliance with State and Federal laws.

SECTION 6
6-1 GENERAL
6-1.01 INCREASED OR DECREASED QUANTITIES -- If the total
pay quantity of any item of work. subject to the provisions in
Section 3-2.2.1, "Increased or Decreased Quantities". of the
Standard Specifications varies by more than 25 percent.

Provisions, subject to the restrictions of Section 20452 and
20455 of the Public Contract Code.
When the compensation payable for the number of units of an
item of work performed in excess of 125 percent of the Engineer's
Estimate is less than $1,500. at the applicable contract unit
pri ce. the Engi neer reserves the ri ght to make no adjustment in
said price if he so elects. except that an adjustment will be
made if requested in wri ti ng by the Contractor, subject to the
restrictions of Sections 20452 and 20455 of the Public Contract
Code. Such Contractor's request shall be accompanied by
adequate. detailed data to support costs of the item.
Should the total pay quantity of any item of work required
under the contract be less than 75% of the Engineer's Estimate,
therefore, the Engineer reserves the right to make no adjustment
in said price if he so elects, except that an adjustment will be
made if requested in wri ti ng by the Contractor. Such
Contractor's request shall be accompanied by adequate. detailed
data to support costs of the item.
The payment for the total pay quantity of such item
will in no case exceed the payment which would be made

6-1.02 SOUND CONTROL REQUIREMENTS -- The Contractor shall
comply with Chapter 9.54 of the City of San Bernardino Municipal
Code regulating and prohibiting loud, unnecessary and excessive
noises.
Each internal combustion engine, used for any purpose on the
job or related to the job. shall be equipped with a muffler of a
type recommended by the manufacturer. No internal combustion
engine shall be operated on the project without said muffler.
No equipment, machinery, or apparatus that permits loud and
excessive noise shall be operated during the hours of 10:00 p.m.
and 7:00 a.m., unless approval has first been secured from the
Mayor and Common Council of the City of San Bernardino.

Said noise level requirement shall apply to all equipment on
the jOb or rel ated to the job, i ncl udi ng but not 1 imi ted to
trucks, transit mixers or transit equipment that mayor may not
be owned by the Contractor. The use of loud sound signals shall
be avoided in favor of light warnings except those required by
safety laws for the protection of personnel.
6-1. 03 PERMITS AND LICENSE -- The Contractor shall obtain
a City Business License, prior to execution of the contract.
6-1.04 EXTRA WORK -- Any extra work done shall conform to the
provlslons of Section 3-3, "Extra Work", of the Standard
Specifications, subject to the restrictions of Section 20452 and
20455 of the Publ ic Contract Code. However, equipment rental
rates shall conform to State of California Business and
Transportation Agency, Oepartment of Transportation, Division of
Construction, "LABOR SURCHARGE AND EQUIPMENT RENTAL RATES",
latest edition, unless the extra work is done for a negotiated
price.
6-1.05 HOURS OF LABOR -- In the event that the. Engineer is
requi red by the Contractor's operati ons to work more than ei ght
(8) hours in any given day, or more than forty (40) hours in any
given week, or on any Saturday, Sunday, or Holiday, in the
setting of Lines and Grades or performing inspections, the
Contractor shall pay an amount to the City equal to one and a
half (1 1/2) times the Engineer's normal wages and fringe
benefits. Such amount shall be charged as an incidental cost
towards the project.
6-1.06 PAYMENTS -- In accordance with the provisions of the
Resolution Ordering this work, the City Engineer shall make and
issue a warrant, assessment, and diagram as provided for in the
above menti oned improvement act, for the expense of the work of
the aforesaid at the unit prices for each item of construction as
listed herein, and such incidental expenses as are necessarily
incurred in accomplishing said work.
No payment will be made for any materials on hand which are
furnished but not incorporated in the work.

6-1.07 PROJECT APPEARANCE -- The Contractor shall maintain
a neat appearance to the work.
In any area visible to the public, the following shall
apply:
When practicable, broken concrete and debris developed
during the construction operation shall be disposed of
concurrently with its removal. If stockpiling is necessary, the
material shall be removed or disposed of weekly.
6-1.08 DISPOSAL OF EXCESS EXCAVATED OR REMOVED MATERIAL --
unless otherwise specified all excess excavation or removed
material shall become the property of the Contractor and shall be
disposed of away from the site of the work.
6-1.09 PAYMENT -- Full compensation for conforming to the
requirements of this section, not otherwise provided for, shall
be considered as included in the prices paid for the various
contract items of work involved and no additional compensation
will be allowed therefor.

SECTION 7
7-1.01 GENERAL The work to be done consi sts, in
general, of removing the existing gravel, roofing membrane and
insulation board; installation of base sheet or inverted cap

membrane with roof coating and such other items or details, not
mentioned above, that are required by the manufacturer, these
Special Provisions and as directed by the Engineer.

SECTION 8
8-1 ROOFING
PART I GENERAL -- Roofi ng shall be performed in accordance
with the Uniform Building code, 1988 Edition, Chapter 32.
A. MATERIALS
1. Modified Bitumen Membrane shall be as manufactured
by Dibiten USA, 4301 East Firestone Boulevard,
South Gate, CA 90280 Phone No. (800) 367-8315,
or approved equal.
2. Base sheet shall be Type G-2 fiberglass.
3. Inverted cap sheet shall be 72 pound fiberglass.
4. t.1odivents shall be 10" high, thermoplastic with
12.5" flange base as manufactured by MODISYSTEMS,
Phone No. (800) 367-8315 or approved equal.
5. Zonolite Fasteners shall be one piece, G-90,
hot-dipped, galvanized steel, 1.7-inch long stem 2
3/4-inch diameter, G-90, hot-dipped, glavanized
steel disk for Class 1-90 wind uplift as
manufactured by Grace Constructi on Products.

MOD/VENT has been especially made for modified
bijumen and BUR.
MOD/VENT allows the evaporation of moisture in new
and existing built-up roofing systems. It eliminates
blistering, cracking, and loosening of membrane joints
caused by interstitial condensation.
Keeps insulation dry and does not allow the moisture to
decrease the thermal efficiency of the roof insulation.
INSTALLATION INSTRUCTIONS
Without Insulation
1) Install vapor barrier.
2) Install waterproofing membrane.
3) Cut an "X" through the membrane to the substrate.
4) Lift the flaps of the "X", and install the Modivent
against the substrate.
5) Heat a scrap piece of bitumen membrane ,and spread
the me~ed bijumen onto the topside of the Modivent
flange.
6) Heat the underside of the flaps and seal to the
Modivent using the trowel.
7) Cut a piece of modified bitumen membrane large
enough to fit over the Modivent and extend 6" back
onto the roof in all directions. Cu1 a hole in the center of
this piece, & slip overthe Modivent. Torch and trowel
into place.
8) Cut a minimum 3" wide strip of modified bitumen
membrane ,long enough to wrap around the base of the
Modivent, and cut notches along its entire length. Heat
this "collar" piece with torch, apply securely to the base
of Modivent (notches spread out onto deck). and torch &
trowel to achieve a secure seal.
With insulation
1) Install roofing system.
2) Cut a hole where the Modivent will be positioned,
through the in~ulation.
3) Heat area of modified bitumen membrane where the
flange will rest (adjacentto the hole) and pOSition the
Modivent.
4) Heat a scrap piece of modified bitumen membrane,
and spread the me~ed bitumen onto the topside of the
Modivent flange.
5) Cut a piece of modified bitumen membrane large
enough to fit over the Modivent and extend 6" back onto
the roof in all directions. Cut a hole in the center of this
piece, & slip overthe Modivent. Torch and trowel into
place.
6) Cut a minimum 3" wide strip of modified bitumen
membrane,long enough to wrap around the base of the
Modivent, and cut notches along its entire length. Heat
this "collar" piece with torch, apply securely to the base
of Modivent (notches spread out onto deck), and torch &
trowel to achieve a secure seal.

expenses incurred by or in consequence of the suspension or
discontinuance of work, and for well and faithfully completing
the work and the whole thereof, in the manner and according to
the Plans and Special Provisions, and requirements of the
Engineer under them.
3. City hereby promises and agrees with the said
Contractor to employ, and does hereby employ the said
Contractor to provide the materials and to do the work
according to the terms and conditions herein contained and
referred to, for the prices aforesaid, and hereby contracts to

pay the same at the time, in the manner, and upon the
conditions above set forth; and the same parties for
themselves, their heirs, executors, administrators, and
assigns, do hereby agree to the full performance of the
covenants herein contained.
4. It is further expressly agreed by and between the
parties hereto that should there by any conflict between the
terms of this instrument and the bid or proposal of said
Contractor, then this instrument shall control and nothing
herein shall be considered as an acceptance of said terms of
said proposal conflicting herewith.
