Qn 116 2 3 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ISSUE BONDS SECURED BY A SPECIAL TAX TO FINANCE CERTAIN FACILITIES OF CITY OF SAN BERNARDINO COMMUNITY FACILITIES DISTRICT NO. 995 (VERDEMONT AREA). 4 5 6 WHEREAS, the City of San Bernardino (the "Ci ty") has 7 adopted a resolution on April 16, 1990 wherein it declared its 8 intention to establish a community facilities district to 9 provide certain facilities (as defined in said resolution, and 10 herein the "Facilities") and to levy a special tax to pay for II the Facilities under and pursuant to the terms and provisions 12 of the "Mello-Roos Community Facilities Act of 1982" (the 13 "Act"), being Chapter 2.5, Part I, Division 2, Title 5 of the Government Code of the State of California, such community facilities district to be known and designated as "City of San Bernardino Community Facilities District No. 995 (Verdemont Area)" (the "Community Facilities District"); and WHEREAS, it is the intention of the City to finance all or a portion of the Facilities through the issuance of bonds, the payment of interest on and principal of which bonds 14 15 16 17 18 19 20 21 will be secured by such special tax, all as authorized 22 pursuant to the Act; 23 H NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO THAT: 25 Section 1. All of the above recitals are true and 26 correct. 27 Section 2. The Mayor and Common Council of the City 28 hereby declare that the public convenience and necessity 04/06/90 (Date prepared) . RESOLUTION OF iNTENTION TO ISSUE BONDS CFD 995 require and it is necessary that a bonded indebtedness be incurred to finance all or a portion of the Facilities for the 2 3 Community Facilities District. Section 3. The purpose for the proposed bonded 4 indebtedness is to finance the acquisition and/or construction 5 of the Facilities, constituting public facilities providing 6 7 service to the property within the District and having an 8 estimated useful life of five years or longer, including 9 planning and design work directly related to the Facilities and all related incidental expenses, as authorized by the Act, more specifically described in Exhibit B of the City's 10 II 12 resolution of intention to establish the District, adopted on 13 April 16, 1990. Section 4. The amount of the proposed bonded 14 15 indebtedness to be incurred to finance all or a portion of the 16 Facilities (including incidental expenses as authorized by the 17 Act) is hereby authorized in an amount not to exceed eleven 18 million dollars ($11,000,000). 19 Section 5. Notice is given that on the 21st day of 20 May, 1990, at the hour of 10:00 o'clock A.M., or as soon 21 thereafter as the matter may be heard, at the regular meeting 22 place of the Common Council, 300 North "D" Street, 23 San Bernardino, California 92418, a public hearing will be 24 held on the intention of the City to incur a bonded 25 indebtedness to finance all or a portion of the Facilities in 26 the Community Facilities District. At the above-mentioned 27 II 28 II 04/06/90 2114c 2 .RESO~UTION OF INTENTION TO ISSUE BONDS CFD 995 . time and place for such public hearing, any persons 2 interested, including all taxpayers, property owners and registered voters within the Community Facilities District, may appear and be heard on the proposed debt issue or on any other matters set forth herein, and they may present any 3 4 5 6 matters relating to the necessity for incurring such bonded 7 indebtedness to pay for all or a portion of the Facilities and 8 to be secured by a special tax to be levied within the 9 Community Facilities District. 10 Section 6. Notice of the time and place of such II public hearing shall be given by the City Clerk in the 12 following manner: A Notice of Public Hearing in the form 13 required by Section 53346 of the Act shall be published in the 14 SAN BERNARDINO SUN, a newspaper of general circulation I, published in the area of the proposed Community Facilities 16 District, which such pUblication shall be made pursuant to 17 Section 6061 of the Government Code, and shall be completed at 18 least seven (7) days prior to the date set for such public 19 hearing; further, a Notice of Public Hearing in the form 20 required by Section 53322.4 of the Act shall be sent by 21 first-class mail, postage prepaid, to each registered voter 22 and to each landowner within the proposed Community Facilities 23 District as shown on the last equalized assessment roll. Said 24 mailing shall be complet~d not less than fifteen (15) days 25 prior to the date of such pUblic hearing. 26 II 27 II 28 II 04/06/90 2ll4c 3 .
