2 RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY DETERMINING THAT
PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE AMENDMENT OF BOUNDARIES OF
3 ASSESSMENT DISTRICT NO. 97.5 BY EXPANDING THE BOUNDARIES THEREOF TO INCLUDE
ADDITIONAL TERRITORY IN THE DISTRICT; DECLARING ITS INTENTION TO PROCEED TO
4 ORDER THE AMENDMENT AND EXPANSION OF THE DISTRICT; AND WAIVING NOTICE: AND
HEARING.

6 WHEREAS, the City of San llenLardino (hereinafter called "City") as an
7 exercise of its municipal a[[airs powers has enacted an Assessment District
8 Onlinemce Ulllllici pal Code Chapt er 1 L. '10) to provide a procedure for the
9 [onnilUon of assessment districts within the City; and

WHEREAS, pltr'SUiUlt to said Municipal Code Chapter 1:<. '10, the (i ty of
San Bernardino, by Resolution 1'10.07-8 adopted ,January .5, 1'187, cr'l"ited
Assessment District No. '17.5 for the maintenance of landscaping in the area of
~li 11 Street and Pepper Avenue; and
WHEREAS, the Assessment District Boundary Map for said Assessment
16 Ili stri ct was recorded in the office of the County Recorder of San Benliinlino
17 County on December 11, 1'186, in Book 40 01 Assessments, page 16; and
18 WHEREAS, pursuant to s.lid Municipal Code Chapter 12.90, the City of
19 San Bernardino, by Resolution No. fi7-407 ",lopted November Il, 1987 "xpanded
20 Assessment])i stri ct No. 97:' to inclllde additional area into the Assessment
21 District; and

WHEREAS, the Amended Assessment District Bouudary Milj> for said

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO THAT:
SECTION 1. Pursuant to Section 12.90.060 of the Siin Berniirdino
Municipal C(lde, the Mayor and C?ommon Council ot Silid City her"eby

require, and it is the intention at the Ma,yo!' and Common Council to amend the
boundaries of Assessment District No. 97:'>, by the expansion thereof to

SECTION:J. Said contemplated work and improvements is oJ more than
lociil nr nrdinary publ ic benefit, dnd t.hat siiid Mayor and Common C01mdl do
hereby make the expense of such work and improvement chargeable
upon the
expanded district, which expanded district is hereby declared to be the
district b~nefi ted by said proposed work and improvement, and to be assessed
to pay the cost and expense thereof.

SECTION 4. That the City elects to proceed withnut Nutice and

the property owners linblP to be itssessed for thE' said mainterwnce.
