HomeMy WebLinkAbout1990-114 , 1 RESOLUTION NO. 90-114 2 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF PORTIONS OF CAROLINE STREET BETWEEN SUNSET DRIVE 3 AND CLUB WAY, AND RESERVING AN EASEMENT FOR SANITARY SEWER AND WATER AND APPURTENANT FACILITIES AND AN EASEMENT FOR PUBLIC UTILITIES THEREIN. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 5 BERNARDINO AS FOLLOWS: 6 7 SECTION 1. That the Mayor and Common Council of the City of San Bernardino hereby declares its intention to order the vacation of 8 a portion of Caroline Street between Sunset Drive and Club Way, described as 9 follows: 10 All that portion of Caroline Street lying between the prolongation of the Easterly line of Club Way (Concourse 11 Way), as delineated on Parcel Map 8401, as per map recorded in Book 34 of Parcel Maps, Pages 83 and 84, in 12 the office of the County Recorder of San Bernardino County, and between the Northerly prolongation of the 13 Westerly line of Sunset Drive as delineated on Parcel Map 11148, as per map recorded in Book 114 of Parcel Maps, 14 Pages 2 and 3, records of said County. 15 SECTION 2. That the Mayor and Common Council of the City of San 16 Bernardino, in vacating the above described portion of said streets, elects 17 to proceed under and in accordance with the provisions of the "Public 18 Streets, Highways and Services Vacation Law", being Division 9, Part 3, of 19 the Streets and Highways Code of the State of California. 20 21 SECTION 3. That the hour of 10:00 A.M. on the 7th day of May, in the Council Chamber of the City Hall, San Bernardino, California, be, 22 and the same hereby is fixed as the time and place when and where all 23 persons interested in or objecting to the proposed vacation may appear 24 before the said Mayor and Common Council and offer evidence in 25 relation thereto. Nothing in this Resolution shall in any way affect or disturb any existing easements for sanitary sewer and appurtenant facilities and any easement for public utility purposes belonging either to the City of San Bernardino or to any public utility and there is hereby reserved for future general public utility purposes and there is specifically reserved for this City, an easement reasonably necessary to locate such sanitary sewer facilities in, over, under or across the real property hereinabove described and to use, maintain, repair, replace or renew such facilities. There is also specifically reserved, an easement for Pacific Bell Telephone to construct, maintain, operate, inspect, maintain, repair, replace, and remove, such aerial and underground telephone, telegraph and communication structures as the company may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers and necessary fixtures and appurtenances. SECTION 5. That the City Engineer of the City of San Bernardino hereby is directed to cause Notices of Street Vacation to be posted as required by the Public Streets, Highways and Services Vacation Law. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution of Intention and shall cause the same to be published once a week for two successive weeks in The Sun, a newspaper published and circulated in the City of San Bernardino, prior to the date of the above public hearing.
