HomeMy WebLinkAbout1990-073 r 02-12-90 1 RESOLUTION NO. ___~Q~I~______ 2 A RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF THAT CERTAIN EAST/WEST ALLEY BETWEEN 3 "G" STREET AND "H" STREET AND BETWEEN SPRUCE STREET AND 6TH STREET AND RESERVING AN EASEMENT FOR PUBLIC UTILITIES THEREIN. 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San declares its intention to order the vacation Bernardino hereby of a portion of that certain East/West alley between "G" Street and "H" Street, and between Spruce Street and 6th Street, described as follows: That certain East/West alley, being a portion of the Kingman and Hampson Subdivision, as per plat recorded in Book 3 of Maps, Page 81, in the Office of the County Recorder of San Bernardino County, State of California, described as follows: Beginning at the Southwest corner of Lot 12 of said subdivision, said point also being the East line of "H" Street, 82.50 feet wide; thence East along the South lines of said Lot 12 and Lots II, 10, 9, 8, 7 and 6 of said subdivision, a distance of 351.40 feet, to the Southeast corner of said Lot 6; thence South, along a straight line, to the Northeast corner of Lot 19 of said subdivision; thence West along the North lines of said Lot 19, and Lots 18, 17, 16, 15, 14 and 13, a distance of 350.6 feet, to the intersection of the Northwest corner of said Lot 13 and the East line of said "H" Street; thence North along said East line, to the Southwest corner of said Lot 12, and the Point of Beginning. SECTION 2. That the Mayor and Common Council of the City of San 21 Bernardino, in vacating the above described portion of said streets ,elects 22 to proceed under and in accordance with the provisions of the "Public 23 Streets, Highways and Services Vacation Law", being Division 9, Part 3, of 24 the Streets and Highways Code of the State of California. 25 SECTION 3. For further particulars as to the proposed vacation of the hereinbefore described portion of said streets, reference is made to that map marked "Plan No. 7885" approved September 6, 1989, on file in the office of the City Clerk of said City. SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing easements for sanitary sewer and appurtenant facilities and an easement for public utility purposes belonging either the to City of San Bernardino or to any public utility, and there is hereby specifically reserved for the Southern California Edison Company, an easement to construct, place, operate, inspect, maintain, repair, replace and remove such aerial and underground communication structures and electrical transmission structures as the company may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers and necessary fixtures and appurtenances, including the right of ingress and egress thereto. SECTION 5. That the City Engineer of the City of San Bernardino hereby is directed to cause Notices of Street Vacation to be posted as required by the Public Streets, Highways and Services Vacation Law. SECTION 6.
