RESOLUTION NO.
90-52
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING
THE EXECUTION OF AN AGREEMENT WITH TONY CANO FOR CONSULTING
SERVICES.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
7 hereby authorized to execute for and on behalf of said City an

Agreement with

Tony Cano for consulting services, a copy
9 which is attached hereto as Exhibit RAR and incorporated
10 herein by reference as though fully set forth at length.

SECTION 2.
The authorization to execute the above

rescinded
if
parties
to

13 agreement fail to execute it within sixty (60) days of the

CONTRACT FOR CONSULTANT SERVICES
THIS CONTRACT is entered into this day of
, 1990, by and between the CITY OF SAN BERNARDINO a
mun ic ipal corpor at ion (hereinafter .CITY") and TONY CANO, an
ind i v idual (here inafter "CANO.).

This contract is made and entered into with respect to
the following:
1. CITY, Public Services Department, Refuse Division,
Commercial Section, is currenty engaged in a survey of front-end
loader routes; and
2. CITY has determined that previous personnel
experience with the commercial refuse accounts, commercial
refuse routing and the city streets is necessary for the timely
and accurate completion of the survey; and
3. Cano was formerly employed by the City of San Bernar-
dino in the Refuse division for 34 years, retiring as a

NOW, THEREFORE, the parties do hereby agree as follows:
1. CLARIFICATION OF CONSULTANT STATUS. CANO shall begin
service as a Consultant for the City of San Bernardino effective
the day of , 1990. As Consultant, his
duties and responsibilities shall be generally outlined under
SCOPE OF SERVICES, as set forth herein.

2. SCOPE OF SERVICES. CANO will accompany, or follow in
a separate vehicle, designated routes from stop to stop, five
days a week, collecting and verifying addresses, container
sizes, bin and inventory numbers and account numbers for each
commercial account. He will confer and coordinate with the
commercial refuse staff and will submit on a daily basis the
results of the day's survey for data input purposes into the
CITY's new refuse routing system.
3. TERM. This contract shall be for a period of ninety
(90) calendar days beginning on the day of ,
1990. The parties recognize and agree that the services to be
performed hereunder will be be on an hourly basis.
4. TERMINATION. This contract may be terminated at any
time by either party, upon seven (7) - calendar days written
notice.
5. COMPENSATION. CANO shall be entitled to compensation
of $7.00 per hour for every eight (8) hours worked in one day.
Cano shall be entitled to time-and-one-half for every hour or
fraction thereof worked beyond eight hours in one day. The
maximum CANO may receive under this contract is six thousand
dollars ($6,000.00).
6. METHOD OF BILLING AND PAYMENT. CANO will submit to
the Department of Public Services Administrative Operations
Supervisor on a weekly basis a daily record of time spent work-
ing on the survey and compiling information for the survey.
CANO is to submit bi-weekly basis, on designated dates, a
billing for services rendered during the preceding two weeks.

processing period which is a maximum of two weeks.
7. REIMBURSEMENT OF EXPENSES. No reimbursable expenses
will occur. The CITY will provide a city vehicle for CANO's use
during the survey, for survey purposes only, and is at no time
to be used for personal use.

9. PARTIAL INVALIDITY. If any provision in this con-
tract is held by a court of competent jurisdiction to be
void or unenforceable, the remaining provisions shall nonethe-
less continue in full force.
