HomeMy WebLinkAbout1991-478 1 RESOLUTION 91-478 2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH EMERGENCY CARE INFORMATION CENTER 3 RELATING TO AMBULANCE SERVICES STUDY. 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said city an Agreement with Emergency Care Information Center a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. The authorization to execute the above-referenced Agreement is rescinded if the parties to the Agreement fail to execute it within sixty (60) days of the passage of this resolution. City hereby engages Consultant to perform the following services: A. Describe and compare the method of service delivery between the following operational modes: 1. Privatization of emergency medical services, including paramedic and ambulance service; 2. City-operated paramedic and ambulance services; 3. City-operated paramedic service with private ambulance transport. B. Compare the operational profile of the three identified modes, including vehicles, equipment, EMS staffing, field supervision, documentation procedures, quality assurance, response times, and agreements with other agencies. C. Perform a cost analysis of the current City-franchised ambulance rates and compare with other local ambulance services. Review costs to provide service. Analyze long- term viability of privatization of paramedic services. D. Determine feasibility of medical priority dispatching. / / / / 1 2. Consultant shall be paid at the rates as specified in 2 Exhibit A. Maximum compensation shall not exceed $10,000. 3 3. Consultant shall maintain and file with the city 4 Administrator of city a record of all hours worked on assigned 5 study. Supervision of Consultant shall be coordinated with the 6 City Administrator or her designee. Consultant shall at such time 7 intervals as directed by the city Administrator, submit a claim 8 based on such records to the City in the manner and form as 9 prescribed by the city Administrator. 10 4. This Agreement shall commence upon execution of this 11 contract by both parties. This Agreement may be terminated by 12 either party upon thirty (30) days written notice to the other. 13 5. For all purposes Consultant shall be considered as an 14 independent contractor and not as an employee of the City. 15 6. Except as specifically provided herein, Consultant shall 16 not be entitled to any employee benefits, such as, but not limited 17 to, vacation leave or accrual, sick leave, retirement benefits, 18 paid vacation, seniority, etc. City shall not deduct from 19 Consultant's compensation any withholding except as is required for 20 such independent contractors. Consultant agrees to defend, indemnify, save and hold 2 city, its officers, agents and employees harmless from any claim or 3 suits that may be brought by third persons on account of personal 4 injury, death, or damage to property, or a property or business or 5 personal interest, arising from any negligent act or omission by 6 Consultant while performing services under this Agreement. 7 8.
