Ql_.ll1~ NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: That the City of San Bernardino, a Municipal 8 9 Corporation, does hereby grant an easement to Southern California 10 11 12 13 Edison Company to construct and maintain electrical service to the Water Department's Foothill boosting station, located at 2001 Foothill Blvd. SECTION TWO: That the said Grant of Easement referred to 14 herein, a copy of which is attached hereto, marked Exhibit "A", and 15 is hereby referred to and made a part hereof as fully as though 16 set forth at length herein, is hereby approved. 17 SECTION THREE: That the Mayor and City Clerk of the City of 18 San Bernardino are hereby authorized and directed to execute said 19 Grant of Easement on behalf of the City of San Bernardino. 20 I HEREBY CERTIFY that the foregoing resolution was duly 21 adopted by the Mayor and Common Council of the City of San 22 Bernardino at a 23 on the 7th 24 vote to wit: 25 IIII 26 IIII 27 IIII 28 IIII 9/19/91 meeting thereof, held reqular day of October , 1991, by the following RESOLUTION GRANTING AN EASEMENT TO SOUTHERN CALIFORNIA EDISO~ COMPANY TO PROVIDE ELECTRIC SERVICE TO THE WATER DEPARTMENT'S FOOTHILL BOOSTING STATION. 1 2 3 4 5 6 7 8 9 10 11 12 13 of 14 15 16 APPROVED AS TO FORM 17 AND LEGAL CONTENT: Council MAIIlhArs : AIlS. "'-:;'" CITY OF SAN BERNARDINO, a Municipal corporation, (hereinafter referred to as "Grantor"), hereby grant to SOUTHERN CALIFORNIA EDISON COMPANY, a corporation, its successors and assigns (hereinafter referred to as "Grantee"). an easement and right of way to construct, use, maintain, operate, alter, add to, repair, replace, reconstruct, inspect and remove at any time and from time to time underground electrical supply systems and communication systems (hereinafter referred 10 as "systems.), consisting of wires, underground conduits, cables, vaults, manholes, handholes, and including above-ground enclosures, markers and concrete pads and other appurtenant fixtures and equipment necessary or useful for distributing electrical energy and for transmitting intelligence by electrical means, in, on, over, under, across and along that certain real property in the County of San Bernardino, State of California, described as follows: ~ :...' . ~,-'~. .' .. A strip of land 14 feet in width lying within a portion of the Northeast one-quarter of Section 7, Township 1 South, Range 4 West, San Bernardino Meridian. The centerline of said strip being described as follows: COMMENCING at the intersection of the centerlines of Foothill Boulevard, 100 feet wide, and Rancho Avenue, as now established; thence easterly along said centerline of Foothill Boulevard, a distance of 301' feet; thence southerly on a line parallel to the centerline of said Rancho Avenue, a distance of 94 feet to the TRUE POINT OF BEGINNING; thence continuing southerly along said line, a distance of 8 feet to a point hereinafter referred to as Point ~A.; thence continuing southerly along said line, a distance of 8 feet. ALSO a strip of land 6 feet in width lying within said Northeast one-quarter of Section 7; the centerline of said strip being described as follows: BEGINNING at the aforementioned Point .N; thence South 6]030' East, a distance of 64 feet. This legal description was prepared pursuant to Sec. 8730(c) of the Business & Professions Code. The Grantor agrees for itself, its successors and assigns. not to erect, place or maintain, nor to permit the erection, placement or maintenance of any building, planter boxes, earth fill or other structures except walls and fences on the above described real property. The Grantee, and its contractors, agents and employees, shall have the right to trim or cut tree roots as may endanger or interfere with said systems and shall have free access to said systems and every part thereof, at all times, for the purpose of exercising the rights herein granted; provided, however, that in making any excavation on said property of the Grantor, the Grantee shall make the same in such manner as will cause the least injury to the surface of the ground around such excavation, and shall replace the earth so removed by it and restore the surface of the ground to as near the same condition as it was prior to such excavation as is practicable.
