RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION
OF A GRANT DEED CONVEYING CERTAIN SURPLUS PROPERTY LOCATED ON THE WEST SIDE
OF DEL ROSA AVENUE BETWEEN MARSHALL BOULEVARD AND EUREKA STREET, IN THE CITY
OF SAN BERNARDINO, TO THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor and City Clerk of the City of San
8 Bernardino, are authorized and directed to execute on behalf of the City, a
9 Grant Deed conveying certain surplus property located on the West side of
10 Del Rosa Avenue between Marshall Boulevard and Eureka Street, to the
11 Redevelopment Agency of the City of San Bernardino.
12 SECTION 2. That said Grant Deed referred to herein, a copy of
13 which is attached hereto, marked Exhibit "A", and is hereby referred to and
14 made a part hereof as fully as though set out at length herein. is approved.

AGREEMENT

THIS AGREEMENT is made this ;:;....tlday of December, 1974, at
San Bernardino, California, by and between the CITY OF SAN BERNA RDINO
a municipal corporation, hereinafter called "CilrY", the BOARD OF LIBRARY
TRUSTEES FOR THE SAN BERNARDINO PUBLIC LffiRARY, hereinafter
called "Board", and BING S. WONG and TING F. WONG, Husband and Wife,
of 3306 Arrowhead, San Bernardino, California, hereinafter called "Donors".
WITNESSETH:

WHEREAS, "Donors" are the owners of a certain parcel of real
property situated in the City of San Eernardino, County of San Bernardino,
State of California and described as follows:
The north 100 feet of that portion of Lot 6, Block 21,
Orange Grove Tract West Highlands, as per plat.
recorded in Book 11 of Maps, page 14, records of
said County, described as follows:

Beginning at the intersection of the center line of
Lemon Street, with the center line of Del Rosa
Avenue; thence north along the center line of
Del Rosa Avenue, 200.feet to the true point of
beginning; thence north along the center line of
Del Rosa Avenue, 300 feet; thence west parallel to
the center line of Lemon Street to the west line of
said Lot 6; thence south along the west line of said
Lot 6, 300 feet to a point 200 feet north of the center
lIne of Lemon Street; thence east parallel to the center
line of Lemon Street to the true point of beginning.
Except portion in Del Rosa A venue
WHEREAS, Donors desire to give said real property to City for use
for library purposes as hereinafter set forth, and City and Board desire to
accept said real property for use pursuant to the terms and conditions set
forth herein.
NOW, THEREFORE, in consideration of the terms, conditions,

provisions, covenants and legal detriments herein contained, it is agreed
as follows:
1. Donors do hereby convey, bargain. sell, set over, transfer,
assign and give to City all that real property sltuated in the City of
San Bernardino, County of San Bernardino, State of California, described
as follows:

. 2. City hereby accepts. said real property upon the follo\\ing

terms and conditions:
(a) City shall hold title to .this parcef of real property

for the San Bernardino Public Library.
(b) City may build a branch library upon said real
property; in the event this is accomplished and the branch library becomes
operational. then City shall be under no further duties pursuant to the
terms of this agreement. Said branch library shall be built within twenty-
one (21) years after the death of the last survivor between the Donors.
(c) tn the event City determines not to build a branch
library upon said property, then City may sell said real property and the

net proceeds received from the sale of said property shall be placed in a
Special Library F~ which Fund shall be used by Board for future
library building programs; said funds shall be used for said purposes
within twenty-one (21) years after the death of the last survivor between the .

Donors.
(d) In the event the property is sold, City shall not
consider "the net proceeds" derived from the sale as a reduction in the
Board's budget requirements, either in the year of sale, or fiscal years
subsequent thereto, it being the intention of the parties hereto, that Donors
gift to the Library shall provide. additional funds for library building
purposes.
3. Donors shall execute and deliver to City a grant deed to the
aforesaid lot and parcel of real property and City shall accept and record

restrictions of record and shall be delivered concurrently with the execution
of this a greemen t.
4. The provisions of this agreement shall bind the heirs,
executors, administrators and assigns of the parties hereto provided,
however, that City shall have the right to sell and convey good and sufficient
title to a purchaser of the property. It is the intention of the parties hereto
that this agreement shall not provide or contain any covenants running with
said parcel of real property.
IN WITNESS WHEREOF, the parties hereto have executed this
