RESOLUTION OF THE CITY OF SAN BERNARDINO GRANTING AN EASEMENT TO
SOUTHERN CALIFORNIA EDISON COMPANY, A CORPORATION, FOR THE UNDERGROUNDING OF
ELECTRICAL TRANSMISSION LINES OVER CITY-OWNED PROPERTY LOCATED ON THE NORTH
SIDE OF 21ST STREET, EAST OF VALENCIA (PORTION OF PERRIS HILL PARK).
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1.
That the Mayor and Common Council of the City of San
7 Bernardino hereby execute a Grant of Easement to Southern California
8 Edison Company, a corporation, for underground transmission of electrical

energy and appurtenant facilities.

That said Grant of Easement referred to
SECTION 2.
a
11 copy of which is attached hereto, marked Exhibit "A", and is hereby referred
12 to and made a part hereof as fully as though set out at length herein, is
13 hereby approved.

That the Mayor of the City of San Bernardino is

15 hereby authorized and directed to execute said Grant of Easement on behalf
16 of the City of San Bernardino.

CITY OF SAN BERNARDINO, a Municipal corporation, (hereinafter referred to as .Granlor~), hereby
grant to SOUTHERN CALIFORNIA EDISON COMPANY, a corporation, its successors and assigns (hereinafter
referred to as ~Grantee.), an easement and right of way to construct, use, maintain, operate, alter, add
to, repair. replace, reconstruct, inspect and remove at any time and from time to time underground
electrical supply systems and communication systems (hereinafter referred to as "systems"), consisting
of wires, underground conduits, cables, vaults, manholes, handholes, and including above-ground
enclosures, markers and concrete pads and other appurtenant fixtures and equipment necessary or useful
for distributing electrical energy and for transmitting intelligence by electrical means, in, on, over,
under, across and along that certain real property in the County of San Bernardino, State of California,
described as follows:
Two strips of land lying within a portion of Lot 5 and 6, Block 40, Rancho San Bernardino, as per
map recorded in Book 7, Page 2, of Maps, Records of said County. The centerline of the first strip
being described as follows:
Strio No 1 /6 feet in width\
COMMENCING at the intersection of 21st Street and Valencia Avenue, as now established; thence
South 80056'22" East, a distance of 65 feet; thence North 0002'25~ East, a distance of 30 feet
more or less to a point on the northerly line of said 21 st Street, said point being the TRUE POINT OF
BEGINNING; thence North 450 East, a distance of 10 feet; thence Easterly parallel to the northerly
line of said 21st Street 787 feet to a point hereinafter referred to as Point ~A".
Strio No 2 (10 feet in width\
ALSO a strip of land lying within said portion of Lot 6; the centerline of said strip being
described as follows:
COMMENCING at the aforementioned Point "A~; thence South 8g056'22~ East, a distance of 105
feet to the TRUE POINT OF BEGINNING; thence continuing South 8go56'22~ East, a distance of;2S
feet.
EXCEPTING THEREFROM any portion thereof lying within said 21 st Street.
This legal description was prepared pursuant to Sec. 8730(c) 01 the Business & Professions Code.
The Grantor agrees for itself, its successors and assigns, not to erect, place or maintain, nor to
permit the erection, placement or maintenance of any building, planter boxes, earth fill or other
structures except walls and fences on the above described real property. The Grantee, and its
contractors, agents and employees, shall have the right to trim or cut tree roots as may endanger or
interfere with said systems and shall have free access to said systems and every part thereof, at all
times, for the purpose of exercising the rights herein granted; provided, however, that in making any
excavation on said property of the Grantor, the Grantee shall make the same in such manner as will cause
the least injury to the surface of the ground around such excavation, and shall replace the earth so
removed by it and restore the surface of the ground to as near the same condition as it was prior to such
excavation as is practicable.
