HomeMy WebLinkAbout1991-362 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 RESOLUTION NO. 91-362 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CREATING UNDERGROUND UTILITY DISTRICT NO. 21, ALONG PORTIONS OF 3 CENTRAL AVENUE, SOUTH OF HIG!ll.AND AVENUE AND ALONG PORTIONS OF PALM AVENUE, SOUTH OF HIGHLAND AVENUE. WHEREAS, a public hearing was held on August 5, 1991, at the hour of 10:00 a.m., at the Council Chambers, 300 North "D" Street, San Bernardino, California, to determine whether the public necessity, health, safety or welfare required the formation of an Underground Utility District No. 21 located along portions of Central Avenue, South of Highland Avenue and along portions of Palm Avenue, South of Highland Avenue San Bernardino, California; and WHEREAS, notice of such hearing has been given to all affected utilities concerned in the manner and for the time required by law; and WHEREAS, such hearing has been duly and regularly held and all persons interested have been given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS FOLLOWS: SECTION 1. It is hereby found and determined pursuant to Chapter 13.36 of the San Bernardino Municipal Code of the City of San Bernardino, and to definitions contained therein that the public necessity, health, safety and welfare require the formation of an underground utility district located along portions of Central Avenue, South of Highland Avenue and along portions of Palm Avenue, South of Highland Avenue, in the City of San Bernardino, State of California, public streets which are extensively used by the general public and carry a heavy volume of vehicular traffic, in order to remove utility poles, overhead wires and associated structures and to underground utilities along said portions of said streets. SECTION 2. An underground utility district to be known as 07-16-91 RESOLUTION CREATING UNDERGROUND UTILITY DISTRICT NO. 21, ~OCATED GENERALLY ALONG PORTIONS OF CENTRAL AVENUE AND ALONG PORTIONS OF PALM AVENUE, SOUTH OF HIGHLAND AVENUE . 1 UndergroUIld Utility District No. 21 is hereby established in that area 2 located along portions of Central Avenue, South of Highland Avenue and along 3 portions of Palm Avenue, South of Highland Avenue, in the City of San 4 Bernardino, State of California, the boundaries of which are more 5 particularly shown on Plan No. 8479, on file in the office of the City Clerk 6 of said City. 7 SECTION 3. All poles, overhead wires and associated overhead 8 structures shall be removed and undergrounded within said underground 9 utility district within the following times: 10 a. Underground installation by utility companies and not later 11 than August 31, 1992. 12 b. Removal of poles, overhead wires and other associated 13 structures not later than December 31, 1992. 14 c. Said times may be extended by the Director of Public Works, as 15 deemed necessary, for the proper scheduling and coordinating of appurtenant 16 work. 17 SECTION 4.
