HomeMy WebLinkAbout1991-304 'I 1 RESOLUTION NO. 91-304 2 RESOLUTION OF THE CITY OF SAN BERNARIlINO CONFIRMING TIffi 1991- 92 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 994, CITY-WIDE STREET 3 LIGHTING AND STREET SWEEPING ASSESSMENT DISTRICT. 4 5 6 Counci I required WHEREAS, by Resolution No. 90-323, the Mayor and Commo found that the public interest, convenience, and necessity the formation of a City-wide street lighting and street 7 sweeping Assessment District: and 8 9 10 Council No. 994 WHEREAS, by said Resolution No. 90-323, the Mayor and Common formed an assessment district known District as Assessment for the of providing City-wide street sweeping and purpose 11 street lighting services pursuant to the provisions of Chapter 12.90 of 12 the San Bernardino City Municipal Code; and 13 14 15 WHEREAS, by the Mayor and Common Resolution No. 90-207, Council declared that all the land included within the boundaries of district will street sweeping and street said be benefited by 16 lighting; and 17 WHEREAS, said Resolution No. 90-207 declared that an annual 18 assessment shall be levied on all land within the district to provide 19 funding for said street lighting and street sweeping: and 20 WHEREAS, Assessment Roll has been prepared totaling an 21 $3,130,463.95, of which $ 136,555 is administrative costs and incidental individual assessments to be levied on 22 expenses, which sets forth the 23 each of the parcels of land within Assessment District No. 994 for the 24 fiscal year 1991-92; 25 26 Common WIffiREAS, said Resolution No. 90-207 requires that the Mayor and Council of the City of San Bernardino make a finding and 27 determination that an amount equal to the net amount of the proceeds of the 28 total assessments for the fiscal year 1990-91 has been used for law 06-03-91 RESOLCTION CONFIRMING ASSESSMENT ROLL NO.99~, CITY-WIDE STREET SWEEPING AND STREET LIGHTING ASSESSMENT DISTInCT. 1 enforcement services, dnd s<1_id Resolution No. 90-207 requires that the total 2 amount of increase, if any, of each annual assessment roll, excluding 3 administrative costs, does not exceed the Consumer Price Index for the Los 4 Angeles-San Bernardino-Riverside area, as published by the United States 5 Department of Labor, Bureau of Labor Statistics, or five percent (5%), 6 whichever is less. 7 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: MAYOR AND COMMON 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 1. That the Mayor and Common Council of the City of San Bernardino do hereby find and determine that an amount equal to the net amount of the proceeds of the total assessments received for the fiscal year 1990-91 has been used for law enforcement services. SECTION 2. That the Mayor and Common Council of the City of San Bernardino do hereby further find and determine that any increase in the total amount of the assessment roll as set for-th herein, excluding administrative costs, does not exceed the Consumer Price Index for the Los Angeles-San Bernardino-Riverside area, as published by the United States Department of Labor, Bureau of Labor Statistics, or five percent (5%), whichever is less. SECTION 3. That the Mayor and Common Council do hereby further find and determine that the proportionate costs to be levied against the parcels of land within Assessment District No. 994 are correctly set forth on Assessment Roll No. 994 for the fiscal year 1991-92, on file in the office of the City Clerk, and do hereby confirm said assessments. SECTION 4.
