HomeMy WebLinkAbout1991-288 RESOLUTION NO.. 91-288 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION OF THE CITY OF SAN BERNARDINO FIXING AND DETERMINING THE FEES AND CHARGES TO BE CHARGED FROM THE COLLEC- TION AND DISPOSAL OF REFUSE, AND REPEALING RESOLUTION NO. 90-244 AND AMENDMENTS THERETO, AND PROVISIONS FOR AUTOMATED RESIDENTIAL REFUSE COLLECTION. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The fees and charges set forth herein shall apply to refuse collection services provided by the City. SECTION 2. A minimum fifty dollar ($50.00) deposit shall be required for each new commercial refuse account. Said deposit must be paid prior to the City commencing refuse collection service. This deposit shall be retained by the City and applied to any closing bill upon termination of service. Any excess amount shall be refunded. SECTION 3. ~9J-J-?~tJ9)1. ,3.)19.. PJpP9pflL_QLE~fJHHL_::: Sinqle FamilY_E~pjg~D~ep~ For collection and disposal of refuse, the owner or authorized agent, of any single-family residential premises, or portions, thereof, located within the territorial limits of the City of San Bernardino, shall pay the fOllowing fee: $13.00 per month for regular twice per week curbside or alley service. $13.00 per month for two (2) times per week automated refuse service plus $9.00 per month for each additional ninety (90) gallon automated container requested. Service is implemented for approximately 12,000 single-family dwellings within the incorporated limits of the City of San Bernardino. For collect ion and r'lisposi'll of refuse, the owner or authorized agent of any apartment house, court, mobile home park, trailer court, duplex or other multiple dwelling unit complex shall pay the following fees: NUMBER Of. It shall be the duty of the Director of Public Services to determine the number of units actually used, or capable of being used, for housekeeping purposes and to adjust the assessment for each use accordingly. A monthly rental fee shall be charged for the use of City-owned bins and shall be in addition to the collection and disposal fee. (bl All fees pursuant to this Section shall be reviewed periodically and, on the basis of findings, monthly fees shall be adjusted to maintain conformance with the fee schedule set forth in Subsection (al above, except that monthly fees shall not be 26 adjusted in relation to temporary variations of refuse due to 2i 28 seasonal factors, where such variations from the average do not extend beyond a three-month period. 5-30-90 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (c) When a City-ewned bin is requested for use on a temporary basis a special delivery charge .of fifteen dellars ($15.00) shall be made fer each such bin, in additien te the regular menthly bin rental fee; said menthly rental fee shall be prerated fer the period of such use, in increments of not less than one (1) week. A service fee equal to twenty-five percent (25%) .of the regular monthly collection and disposal fee for the size of bins so-utilized shall be charged for each time the bin is serviced. (b) In the event the City is required to pay a ripping charge for weight in excess of the above tonnage schedule, that charge shall be a debt of the customer based on a tipping fee at the rate of twenty-nine and twenty-one cents ($29.21) per ton and shall be added to the base fee due the City. (c) Removal of tires shall be at the rate of spventy-e;ght dollars and six cents ($78.06) per ton Disposal Fee plus forty dollars ($40.00) Service Charge. SECTION 9. AJl fees and charges set forth in this resolu- tion shall be collected monthly. SECTION 11. Any service for the collection and disposal of refuse as set forth in this resolution may be discontinued by the Director of Public Services if any fees or charges, as levied herein, are not paid within ninety (90) days from the date said assessment is billed. SECTION 12. The Mayor and Common Council may exempt from and charges of this resolution certain non- the public intere~t.
