RESOLUTION NO. 91-274
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING
THE DIRECTOR OF PARKS, RECREATION AND COMMUNITY SERVICES
3 DEPARTMENT TO EXECUTE AN AGREEMENT WITH SENIOR PROGRAMS
CORPORATION TO PROVIDE SENIOR AIDES TO CITY WORK SITES.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. The Director of Parks, Recreation and
7 Community Services is hereby authorized and directed to
8
execute on behalf of said
city an agreement with the Senior
9 Programs Corporation relating to the placement of senior
aides at City work sites.
A copy of said agreement is
11 attached hereto, marked Exhibit "A" and incorporated herein
12 by reference as fully as though set forth at length.
13 SECTION 2. The authorization granted hereunder shall
14 expire and be void and of no further effect if the agreement
15 is not executed by both parties and returned to the office of
16 the City Clerk within 60 days following effective date of the
17 resolution.

105 SENIOR AIDES PROJECrjOOST 1lGEICY AGREFMEm'
To canp1y wi th the requiranents of the National Council of Senior
citizens Senior AIDES Pragran, operated under Title V of the Older
Americans Act, this Agreanent is voluntarily entered into by
City of San Bernardino
hereinafter referred to as the Host Agency, and
Senior Programs Corp. #29,686 E.Mi11 St.,Rm.1006,San Bdno,CA 92415-0649
a subcontractor of the National Council of Senior Citizens Senior AIDES
progran, hereinafter referred to as the Sponsor Agency.

The Host Agency agrees to provide a safe and heal thful ~rk si te for
each Senior Aide, to provide adequate orientation and training necessary
to perform assigned job duties in accordance with a written job
description, to provide additional training as opportunities occur, and,
to the extent possible, to treat each Senior Aide as a regular member of
the Host Agency staff.
The Host Agency agrees to consider each Senior Aide for regular
anplozment, either full-time or part-time, when vacancies occur in the
Host Agency staff or when new positions are created.
The Host Agency understands that the maximum length of time that a
Senior Aide may ranain in the same job assigrrnent shall not exceed 24
months, except under limited circunstances which will be detennined by
the IeSC Senior AIDES Program. Moreover, the Host Agency understands
that the sponsor Agency reserves the right, following reasonable notire,
to reassign any Senior Aide at any time that reassigrrnent will increase
the Senior Aide's opportunities for training or unsubsidized anp1ozment,
or will otherwise serve the best interests of the Senior Aide, or will
better support the goals and objectives of the Senior AIDES Progran.
The Host J>gency agrees that no other national Title V project sponsor
will be provided a work site while this Agreanent is in effect.
The Host Agency agrees to abide by the hours and ~rk schedules mutually
agreed to for each senior Aide and to provide properly prepared time
sheets, periodic performance e\1a1uations, and other required docunents.
In addition, the Host Agency agrees and understands that each Senior
Aide will be required to attend periodic Senior AIDES Project meetings
during regular working hours.

The H::>st 1<I;lency <r3rees that the job to ltIich the Senior Aide is assigned
is an increase in enplo}'ll\ent opportunities; will not result in the
displaCElllent of currently enplo}'ed workers or in a reduction in non-
overtime hours of work, wages, or benefits; will not impair any existing
contract for service or result in the substitution of the wages of the
Senior Aide for other fums in connection with work which otherwise
would be perfonned; will not be a substitution for any existing
federally assisted job; am will not be in a position which is the sane
as or substantially the same as that occupied by any other person 1Itlo is
on lay-off. Further, the Host Agerx::y agrees that it will not
discriminate <r3ainst a Senior Aide on the grounds of race, color,
religion, sex, national origin, or handicap.
'l'ne H::>st 1<I;lerx::y agrees to provide docunentation of in-kind
contributions, if specified in an accanpanying letter of agreenent.
Further, it is understood by the H::>st 1<I;lency and the Sponsor 1<I;lency that
any contribution, whether cash or in-kind, by the Host Agerx::y is purely
voluntary and is not a condition for the assignnent of any Senior Aide.
The Host Agerx::y certifies by this Agreanent that it is a governnental
agency or is a non-profit <r3ency 1Itlich is currently certified as a
Section 501 (c) (3) organization under the Internal Revenue Code.
Further, if the H::>st 1<I;lency is certified as a Section 501 (c) (3) <r3ency,
a copy of that certification is attached or is on file with the Sponsor
Agency and is still in effect. 'l'ne H::>st 1<I;lency agrees to inform the
Sponsor Agerx::y irnnediately if the Section 501 (c) (3) certification is
changed .
'l'ne Sponsor 1<I;lency <r3rees to recruit, enroll, and assign a Senior Aide
or Senior Aides to the Host Agerx::y for the purpose of engaging in
productive ccrnmunity service anplo}'ll\ent with duties and tasks as
specified in a written job descriptioo.
'l'ne Sponsor 1<I;lency agrees to be responsible for all administrative and
fiscal controls of the senior AIDES project and for payirg wages and
providing fringe benefits to each Senior Aide.
