HomeMy WebLinkAbout1991-245 .. 06-05-91 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 RESOLUTION NO. 91-245 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION TO ORDER THE VACATION OF A PORTION OF HUFF STREET BETWEEN "G" STREET AND CRESCENT AVENUE, AND RESERVING EASEMENTS FOR STORM DRAINS, WATER LINES AND APPURTENANT FACILITIES AND EASEMENTS FOR PUBLIC UTILITIES THEREIN. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the Mayor and Common Council of the City of San declare their intention to order the vacation of a Bernardino hereby portion of Huff Street, described as follows: That portion of Huff Street as conveyed to the City of San Bernardino by document recorded September 17, 1953. in Book 3243, Page 59, Official Records, described as follows: That portion of Blocks 28 and 29 of Rancho San Bernardino, as per plat thereof recorded in Book 7 of Maps, Page 2, Records of the County Recorder of San Bernardino County, State of California, described as follows: Beginning at the intersection of the North line of Huff Street, 60 feet wide and the East line of Crescent Avenue (formerly "G" Street), 60 feet wide; thence East along said North line of Huff Street, a distance of 440 feet, more or less, to the West line of "G" Street, 60 feet wide; thence South along the prolongation of said West line. a distance of 60 feet to the South line of said Huff Street: thence West along said South line, a distance of 440 feet, more or less. to the East line of said Crescent Avenue; thence North along the prolongation of said East line. a distance of 60 feet to the Point of Beginning. SECTION 2. That the Mayor and Common Council of the City of San 22 Bernardino. in vacating the above described portion of said street, elect to 23 proceed under and in accordance with the provisions of the "Public Streets, 24 Highways and Services Vacation Law", being Division 9, Part 3, of the 25 streets and Highways Code of the State of California. 26 SECTION 3. That the hour of 10:00 a.m. on the 15th day of July, 27 1991 in the Council Chamber of the City Hall. San Bernardino, California, 28 be, and the same hereby is fixed as the time and place when and where all 1 "STRE1~ VACATION: PORTION OF HUFF ST. BETWEEN "G" ST. AND CRESCENT AVE. 1 persons interested in or objecting to the proposed vacation may appear 2 before the said Mayor and Common Council and offer evidence in 3 relation thereto. For further particulars as to the proposed vacation of 4 the hereinbefore described portion of said streets, reference is made to 5 that map marked "Plan No. 8031" approved March 5, 1990, on file in the 6 office of the City Clerk of said City. 7 SECTION 4. Nothing in this Resolution shall in any way affect 8 or disturb any existing easements belonging either to the City of San 9 Bernardino or to any public utility and there are hereby specifically 10 reserved for the City of San Bernardino, easements for storm drains, water 11 lines and street light purposes in, over, under, and across the real 12 property hereinabove described, and the right at any time or from time to 13 time, to construct, maintain, operate, replace and renew one or more 14 pipelines and all appurtenances thereto. The easements herein granted shall 15 also include the right to use such area adjacent to the easements as may be 16 reasonably necessary for performing the work and for access to the work 17 during construction and includes rights of ingress and egress. There is 18 hereby specifically reserved for Southern California Edison, an easement 19 over the hereinabove described real property, to construct, place, operate, 20 inspect, maintain, repair, replace and remove such aerial and underground 21 electrical transmission structures, as the company may from time to time 22 require, consisting for poles, anchors, wires, cables, conduits, manholes, 23 markers and necessary fixtures and appurtenances, including the right of 24 ingress and egress thereto. There is also hereby specifically reserved for 25 emergency vehicles, an easement for ingress and egress to above property. 26 SECTION 5. That the City Engineer of the City of San Bernardino 27 hereby is directed to cause Notices of Street Vacation to be posted as 28 required by the Public Streets, Highways and Services Vacation Law. 06-05-91 2 06-05-91 'STREET VACATION: PORTION OF IIUFF ST.
