HomeMy WebLinkAbout1991-229 .. .' , ( 1 2 3 4 5 6 7 RESOLUTION NO. 91-229 RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN BERNARDINO AND THE COUNTY OF SAN BERNARDINO, RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 2671, FOR THE AREA GENERALLY LOCATED EAST OF WATERMAN AVENUE, SOUTH OF 6TH STREET. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. The Mayor and Common Council of the City of 8 San Bernardino hereby find and determine that: 9 A. Pursuant to Section 99 of the Revenue and Taxation Code, prior 10 to the issuance of a certificate of filing by the Local Agency Formation 11 Executive Officer, the governing bodies of all local agencies whose service 12 service responsibilities will be altered by proposed area or a 13 jurisdictional change will negotiate and determine by resolution the amount 14 of property tax revenues to be exchanged between and among such local 15 agencies. 16 B. Except as provided in Section 99.1 of the Revenue and Taxation 17 Code, in the event that a jurisdictional change would affect the service 18 area or service responsibility of one or more special districts, the Board 19 of Supervisors of the County of San Bernardino shall, on behalf of the 20 district or districts, negotiate any exchange of property tax revenues. 21 C. The Mayor and Common Council of the City of San Bernardino and 22 the Board of Supervisors of the County of San Bernardino have determined the 23 of property tax revenues to be exchanged as a result of amount 24 jurisdictional change described by LAFCO 2671. 25 SECTION 2. Implementation. 26 The negotiated exchange of property tax revenues between the A. 27 City of San Bernardino and the County of San Bernardino attached hereto as 28 Exhibit "A" and incorporated herein by reference, resulting from the above 05-28-91 PROPERTY TAX REVENUE EXCHANGE BETWEEN THE CITY AND COUNTY OF SAN. BERNARDINO RESULTING FROM ,JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 2671 FOR THE AREA GENEllALLY LOCATED EAST OF WATERMAN AVENUE, BETWEEN 6TH AND 3RD STREETS. 1 described jurisdictioniil chiinge, is hereby iipproved and a.ccepted. The column 2 entitled "Estimated Current Tax Revenue" shall represent the amount of 3 proper-ty tax revenues for the current year to be piiid to the County of San 4 Bernardino and its affected agencies. 5 B. The iinnual tax increment generated in the area subject to the 6 jurisdictional change and iittributable to the tocal Agencies whose service 7 area or service responsibilities will be altered by the proposed 8 jurisdictional change shall be allocated in the future years pursuant to the 9 provisions of Section 98 of the Revenue and Taxation Code. 10 SECTION 3.
