HomeMy WebLinkAbout1991-228 1 2 3 4 5 6 7 8 9 RESOLUTION NO. 91-228 RESOLUTION OF THE CITY OF SAN BERNARIlINO DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN BERNARDINO AND THE COUNTY OF SAN BERNARDINO, RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 2672, FOR THE AREA GENERALLY LOCATED EAST OF WATERMAN AVENUE, BETWEEN 9TH STREET AND 6TH STREET. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals. The Mayor and Common Council of the City of San Bernardino hereby find and determine that: A. Pursuant to Section 99 of the Revenue and Taxation Code, prior 10 to the issuance of a certificate of filing by the Locill Agency Formation 11 Executive Officer, the governing bodies of all local agencies whose service 12 area service responsibilities will be altered a proposed by or 13 jurisdictional change will negotiate and determine by resolution the amount 14 of property tax revenues to be exchanged between and among such local 15 agencies. 16 B. Except as provided in Section 99.1 of the Revenue and Taxation 17 Code, in the event that a jurisdictional change would affect the service 18 area or service responsibility of one or more special districts, the Board 19 of Supervisors of the County of San Bernardino shall, on behalf of the 20 district or districts, negotiate any exchange of property tax revenues. 21 C. The Mayor and Common Council of the City of San Bernardino and 22 the Board of Supervisors of the County of San Bernardino have determined the 23 amount of property tax revenues to be exchanged as a result of 24 jurisdictional change described by LAFC No. 2672. 25 SECTION 2. Implement'!1ion. 26 A. The negotiated exchange of property tax revenues between the 27 City of San Bernardino and the County of San Bernardino attached hereto as 28 Exhibit "A" and incorporated herein by reference, resulting from the above 05-28-91 PROPERTY TAX REVENUE EXCHANGE BETWEEN THE CITY AND COUNTY OF' SAN 'BERNARDINO JIESULTING FROM ,TIJRISDICTIONAL CHANGE DESCRIBED BY LAFCO 2672 FOR THE AREA GENEI<ALLY LOCATE]) EAST OF WATERMAN AVENUE. BETWEEN 9TH AND 6TH STREETS. 1 described jurisdictionill chilnge. is hereby ilpproved and accept.ed. The column 2 ent.it.led "Est.imated Current. TilX Revenue" shall represent t.he ilmount of 3 property tilX revenues for the curTent year to be paid to t.he Count.y of San 4 llernardino ilnd it.s affected agencies. 5 B. 1be annual tilX increment generated in t.he area subject. to the 6 jurisdictional change and at.tributable t.o the Local Agencies whose service 7 area or service responsihilities will be altered by the proposed 8 jurisdictional change shall be allocat.ed in the future years pursuant. to t.he 9 provisions of Section 98 of the Revenue and Taxation Code. 10 SECTION 3.
