2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING
THE EXECUTION OF AN AGREEMENT WITH THE SAN BERNARDINO CITY
3 UNIFIED SCHOOL DISTRICT RELATING TO THE DELIVERY OF TYPE A
LUNCHES AND SCHEDULE B SNACKS TO CITY'S DELMANN HEIGHTS HEAD
4 START CENTER.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino
is hereby authorized and directed to execute on behalf of
said city an Agreement with the San Bernardino City Unified
School District relating to the delivery of Type A Lunches
and Schedule B Snacks to city's Delmann Heights Head start
Center, for the term of one year and to provide the student
lunches at ninety-eight cents each and the snacks at twenty-
five cents each, a copy of which is attached hereto, marked
Exhibit "A" and incorporated herein by reference as fully as
though set forth at length.
I HEREBY CERTIFY that the foregoing resolution was
duly adopted by the Mayor and Common Council of the city of
San Bernardino at a regular

FOOD SERVICE AGREEMENT
(Fiscal Year)
THIS AGREEMENT, made and entered into this 8th day of May, 1991,
by and between the SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT,
hereinafter referred to as "DISTRICT, " and the CITY OF SAN
BERNARDINO for its Delman Heights Child Care center, hereinafter
referred to as "CITY," is as follows:
R E C I TAL S:
WHEREAS, the CITY desires to have Type A lunches and Schedule B
snacks provided for its Delman Heights Child Care Center; and,
WHEREAS, the DISTRICT has facilities for the preparation of the
needed lunches, and the DISTRICT is willing to provide such service
to the CITY on a cost reimbursement basis;
NOW, THEREFORE, the DISTRICT and the CITY mutually agree as
follows:
1. 'lhe term of this Agreement shall be fram Julv 1. 1991 through June
30. 1992, inclusive, but may be cancelled by either party upon the
givinq of sixty (60) days written notice to the other party. This
Agreement may be amarrled by nu.rtual written consent.
2. Each lunch shall c::anply with Type "A" requ:ireIrents set by the united
states Department of Agriculture for the National School lunch
Program for students' nutritional needs. 'lhe contents of the menus
shall contain such items as are neces""l')' to rooet these requirements.
3. lunches shall not include: milk, straws, utensils, or napkins.
4. 'lhe cost to CITY for Type A lunches and Schedule B snacks is as
follows:
Adult Type A lunch:
Student Type A lunch:
Schedule B snacks:

said rates shall be subject to a proportionate increase in the event
of a reduction in Federal reimbursement arrl/or subsidies.

DISTRIcr an:i the CITY further agree that DISTRIcr SHALL:
1. Prepare an:i deliver Type A lunches, incl\ld.i.n:J ice cream prcducts as
requirErl by lOOIlU, at or before the lunch hour each school day,
incl\ld.i.n:J mi.ni.Im.nn days, in acoordance with the m.nnber of meals
requested for that day. DISTRIcr shall only be responsible for
providin3" lunches, if ne€d.ed, on days that are DISTRIcr school days
an:i food is prepared for distribution.
2. Be responsible for the ~ture an:i quality of the lunches at the
tine of delivery.
3. pick up transport carts.
4. Present CITY with an itemized invoice the first day of each month
for the previous month's deliveries.
5. Assume all liability for prc:prr use an:i protection of surplus
c:x:murodities assigned to it by the CITY.
6. Provide CITY with a monthly lOOIlU one week prior to the beginning of
the period covered by said lOOIlU.
7. Maintain all ~ssary records on the nutritional components of the
lunches an:i the number of lunches delivered to the CITY an:i make
said records available for inspection by state an:i Federal
authorities upon request.
8. rmemnify an:i hold the CITY hannless for any loss, liability, claim,
suit, or judgment, resulting fram work or acts done or anitted by
the DISTRIcr, its officers, employees, an:i agents, in carrying out
this l\greement.
DISTRIcr an:i the CITY further agree that CITY SHALL:
1. Request by telephone no later than 8:30 a.m. on the day of the
delivery, an a=urate number of lunches to be delivered to the CITY
Delman Heights auld Care Center. Errors in count called in shall
be the responsibility of the CITY.
2. Insure that an individual is available at the school at 11:00 a.m.
each school day to receive the requested number of lunches.
3. Provide personnel to serve lunches, clean the serving an:i eating
areas, an:i assemble transport carts for pick up by DISTRIcr at 1:30
p.m. on the same school day.
4. If awlicable, establish collection procedures which are in
acoordance with state an:i Federal regulations relating to the overt
identification of needy pupils an:i keep a=urate records of the
number of free, reduced price, paid an:i adult lunches served daily.

5. If applicable, prepare all claillls for re:iInbursement l.IIrler its own
agreement number, receive am app:rove all free am reduced price meal
applications, am maintain all necesl;'':\J:Y recx>rds to substantiate the
above items.
6. Assign to DISI'RIcr all UJi,.,....lities for which the CITY is entitled
am the liability for use of such <..;uu.,....lities.
7. Pay DISI'RIcr by the tenth of each m:>nth the full am:JUIlt as presented
on the monthly itemized invoice.
8. Bear the sole responsibility to properly care for all refrigerated
perishable food items after they have been delivered to the delivery
site by the DISI'RIcr until the t.i1re of ultimate constlllption.
9. Bear the cost of arry losses resultiIq fram theft or :i.nproper storage
once the food or lunches are received or delivered to authorized
CITY personnel; the CITY assI.IIreS the responsibility to dispose of
such am retum no food items. If CITY has :i.nproperly ordered more
food than it is able to COIlSI.mle, it shall not be entitled to arry
credit on said items fram future food orders.
10. ImemnifY am hold the DISTRIcr hannless for arry loss, liability,
claim, suit, or judgIoont, resultiIq fram work or acts done or omitted
by the CITY, its officers, employees, am agents, in carryiIq out
this Agreement.
11. CITY certifies it will not discriminate on the basis of race, color,
national origin, sex (incl~ sexual harassment), harrlicap (or
disability), religion, or age in arry of its policies, procedures,
or practices in compliance with:
