HomeMy WebLinkAbout1991-214 l 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 RESOLUTION NO. 91-214 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO GRANTING AN EASEMENT TO SOUTHERN CALIFORNIA EDISON COMPANY FOR RELOCATION OF ELECTRIC DISTRIBUTION LINE AT 1302 SOUTH "E" STREET, IN ORDER TO SERVE THE WATER DEPARTMENT I S "E" STREET PUMP STATION FACILITY. NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: That the City of San Bernardino, a Municipal Corporation, does hereby grant an easement to Southern California Edison Company in order to relocate an existing electric distribution line to clear the property for a new building. SECTION TWO: That the said Grant of Easement referred to herein, a copy of which is attached hereto, marked Exhibit" 1", and is hereby referred to and made a part hereof as fully as though set forth at length herein, is hereby approved. SECTION THREE: That the Mayor and City Clerk of the City of San Bernardino are hereby authorized and directed to execute said Grant of Easement on behalf of the City of San Bernardino. A strip of land, 6 feet in width, lying within a portion of Lot 23, Block 54, Rancho San Bernardino, as per map recorded in Book 7, page 2 of Maps, in the Office of the Recorder of said County; the centerline of said strip being described as follows: BEGINNING at a point in the Westerly line of "E- Street, as now established, said paint being distant thereon 128 feet Southerly of the Northerly line of said lot 23; thence North 8go 44' 3r West, 113,25 feet; thence South 000 34' 29" West, a distance of 65 feet. This legal description was prepared pursuant to Sec. 8730(c) of the Business & Professions Code. The Grantor agrees far itself, its successors and assigns, not to erect. place or maintain, nor to permit the erection, placement or maintenance of any building, planter boxes, earth filt or other structures except walls and fences on the above described real property. The Grantee, and its contractors, agents and employees. shall have the right to trim or cut tree roots as may endanger or interfere with said systems and shall have free access to said systems and every part thereof, at all times, far the purpose of exercising the rights herein granted; provided, however, that in making any excavation an said property of the Grantor, the Grantee shall make the same in such manner as will cause the least injury to the surface of the ground around such excavation, and shall replace the earth so removed by it and restore the surface of the ground to as near the same condition as It was prior to such excavation as is practicable.
