HomeMy WebLinkAbout1991-097 1 2 3 4 5 6 7 8 9 10 11 RESOLUTION NO. 91-97 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COSTS OF ABATEMENTS AND IMPOSING LIENS ON CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF THE ABATEMENT OF PUBLIC NUISANCES. (930 W. 6th St., 576 W. 9th St., 677-83 W. 9th St., 1161-63 N. Arrowhead Ave., 980 & 1010 W. Baseline Ave., 1810 Daley Canyon Rd., 2005 Dumbarton, 2025 N. "F" St., 1710 Fairfax Ave., 1432-46 "G" St., 3011 Glenview, 817 N. "H" St., 532 W. Magnolia, 622-24 Mt. Vernon Ave., 1372 Oakhurst Dr., 3613 E. Piedmont Dr., 245 S. Prospect, 540 N. Sierra Way, 1272-74 N. Sierra Way, 537 W. Victoria, 1222 W. Walnut St., 1424 W. Walnut St. ) BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The City of San Bernardino, pursuant to its 12 authority under San Bernardino Municipal Code Chapter 15.28 13 and other laws, did lawfully cause public nuisance abatements 14 on the real property described in Exhibit "A", attached hereto 15 and incorporated herein by reference as though fully set 16 forth. The last known owners of record as to each such parcel 17 are also specified in Exhibit "A". 18 Due notice was given to the person or persons having an 19 interest in said property and a hearing was held by the Board 20 of Building Commissioners to hear protests and to assess the 21 costs of said abatement on said property. The Board of 22 Building Commissioners has entered its order determining the 23 costs to be reasonable and proper and imposing a lien upon the 24 land involved. Notice of the right to appeal to the Mayor and 25 Common Council has been issued to all affected property 26 holders. The Board of Building Commissioners now requests 27 that the Mayor and Common Council confirm the imposition of 28 the liens. 1 II i Resolution of the City of San Bernardino confirming COSLS of i,abatements and imposing liens... (Building Abatements) I I i 1 2 SECTION 2. The matter having now come before the Mayor 3 and Common Council for confirmation of the imposition of the 4 liens imposed, the following costs are found to have been duly 5 incurred by the City pursuant to proceedings under said 6 provisions of the San Bernardino Municipal Code and the final 7 statements of costs on file with the City Clerk are hereby 8 confirmed and adopted as special assessments against the 9 properties listed in Exhibit "A" hereto. 10 11 SECTION 3. If said sum is not fully paid to the City 12 Clerk, City Hall, San Bernardino, within five (5) days after 13 mailing a notice to the person or persons having an interest 14 in said property informing said person or persons of the 15 adoption of this resolution as to any such individual parcel, 16 then said sum shall be and become a lien on said property 17 pursuant to said Municipal Code provisions and applicable laws 18 and shall be collected as a special assessment thereon. 19 20 SECTION 4. In the event said sum is not paid as 21 hereinabove provided, the City Clerk is hereby directed to 22 file a certified copy of this resolution with the Auditor of 23 the County of San Bernardino, State of California, directing 24 that said sum be entered as lien charges against said property 25 as it appears on the current assessment rolls, to be collected 26 at the same time and in the same manner, subject to the same 27 penalties and interest upon delinquencies, as the general 28 taxes for the City of San Bernardino are collected. 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Resolution of the City of San Bernardino confirming costs of abatements and imposing liens...
