RESOLUTION NO. 91-95
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO GRANTING AN EASEMENT TO SOUTHERN CALIFORNIA EDISON
COMPANY TO CONSTRUCT AND MAINTAIN ELECTRIC SERVICE AT THE WATER
DEPARTMENT'S MEYERS CANYON RESERVOIR.

NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL
6 OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION ONE:
That the City of San Bernardino, a Municipal
8 Corporation, does hereby grant an easement to Southern California
9 Edison Company to construct and maintain electrical service to the

Water Department's Meyers Canyon Reservoir, located at 7301 Little
League Drive.
SECTION TWO:
That the said Grant of Easement referred to
herein, a copy of which is attached hereto, marked Exhibit "A", and
is hereby referred to and made a part hereof as fully as though
15 set forth at length herein, is hereby approved.
16 SECTION THREE: That the Mayor and City Clerk of the City of
17 San Bernardino are hereby authorized and directed to execute said
18 Grant of Easement on behalf of the City of San Bernardino.

CITY OF SAN BERNARDINO, a Municipal corporation, (hereinafter referred to as ~Grantor"), hereby
grant to SOUTHERN CALIFORNIA EDISON COMPANY, a corporation, its successors and assigns (hereinafter
referred to as "Grantee-). an easement and right of way to construct, use, maintain, operate, alter, add
to, repair, replace, reconstruct, inspect and remove at any time and from time to time underground
electrical supply systems and communication systems (hereinafter referred to as ~systems.), consisting
of wires, underground conduits, cables, vaults, manholes, handholes, and including above-ground
enclosures, markers and concrete pads and other appurtenant fixtures and equipment necessary or useful
for distributing electrical energy and for transmitting intelligence by electrical means, in, on, over,
under. across and along that certain real property in the County of San Bernardino, Slate of California,
described as follows:
A strip of land, 10 feet in width, lying within a portion of the Southwest 1/4 of Section 36.
Township 2 North, Range 5 West, San Bernardino Meridian; the centerline of said strip being
described as Mows:

COMMENCING at the Southeast corner of said Southwest 1/4; thence Westerly, along the Southerly
line of said Southwest 1/4, 835 feet; thence North 640 West, 885 feet; thence Northerly, parallel
with the Westerly line of said Southwest 1/4, 825 feet; thence Westerly, parallel with the
Southerly line of said Southwest 1/4, 79.2 feet; thence North 640 West, 330.8 feet; thence
Northerly, parallel with the Westerly line of said Southwest 1/4, 137 feet to the TRUE POINT OF
BEGINNING; thence North 530 East, a distance of 50 feet.
This legal description was prepared pursuant to Sec. 8730(c) of the Business & Professions Code.
The Grantor agrees for itself, its successors and assigns, not to erect, place or maintain, nor to
permit the erection, placement or maintenance of any building, planter boxes, earth fill or other
structures except walls and fences on the above described real property. The Grantee, and Its
contractors, agents and employees, shall have the right to trim or cut tree roots as may endanger or
interfere with said systems and shall have free access to said systems and every part mereof, at all
times, for the purpose of exercising the rights herein granted; provided, however, that in making any
excavation on said property of the Grantor, the Grantee shall make the same in such manner as will cause
the least injury to the surface of the ground around such excavation, and shall replace the earth so
removed by it and restore the surface of the ground to as near the same condition as it was prior to such
excavation as is practicable.
