HomeMy WebLinkAbout1991-073 , . . , RESOLUTION NO. 91-73 2 RESOLUTION OF THE CITY OF SAN BERNARDINO REFERENCING PREVAILING WAGE SCALE AND CALLING FOR CONSTRUCTION BIDS FOR ASSESSMENT DISTRICT NO. 987 (VERDEMONT AREA) 3 4 5 WHEREAS, the Mayor and Common Council (the "Common 6 7 8 Council") of the City of San Bernardino (the "City") are considering the formation of an assessment district, pursuant 9 to the Municipal Improvement Act of 1913 (the "Act"), being 10 Division 12 (commencing with Section 10000) of the California II Streets and Highways Code, for the construction of certain 12 public works and improvements and acquisitions, if necessary, 13 generally described as follows: 14 Zone I: Grading, excavation and appurtenant construction required to install a box culvert in Cable Creek to raise the Palm Avenue grade, including street improvements, traffic signal and appurtenances; 15 16 Zone 2: Construction of a storm drain system and appurtenant construction required to install a storm water and debris retention facility, including manhole installation and safety-related amenities; 17 18 19 Zone 3: Construction of street improvements for Palm Avenue within an 88 foot right-of-way, including sewer with manholes, storm drain system, street lights and appurtenant construction; 20 21 (the "Improvements"); 22 WHEREAS, the lands to be specially assessed for the 23 Improvements shall be included within an assessment district 24 designated 25 ASSESSMENT DISTRICT NO. 987 (VERDEMONT AREA) 26 27 (the "Assessment District"); 28 WHEREAS, it is the intention of the Common Council 3378m5 02104/91 RESOLUTION CALLING FOR CONSTRUCTION BIDS 2 3 4 5 6 7 8 9 10 II 12 13 14 15 16 17 /8 19 20 21 22 23 24 2S 26 27 28 to call for sealed proposals or bids for the work and improvements to be constructed in the Assessment District; WHEREAS, it is necessary to determine the prevailing rate of wages for the various classifications of workers required in the performance of the work: NOW, THEREFORE, the Mayor and Common Council of the City of San Bernardino do hereby resolve as follows: SECTION 1. The above recitals and each of them are true and correct. SECTION 2. It is hereby determined and ascertained that the general prevailing rate of per diem wages in the locality in which said work described is to be performed, together with appurtenances, in the Assessment District under the provisions of the Act for each craft or type of worker or mechanic needed to execute the contract, and also the general prevailing rate for legal holiday and overtime work for each craft or type of worker or mechanic, is in accordance with the schedule obtained from the Director of Industrial Relations, pursuant to the provisions of Section 1773 of the California Labor Code, and reference is hereby made to copies thereof on file with the transcript of these proceedings, which copies are available to any interested party upon request. Further, a copy shall be posted at each job site during the course of construction. SECTION 3. The Superintendent of Streets is hereby authorized and directed to call for sealed bids on the Improvements to be constructed; the proposals or bids shall be 3378m5 2 02/04/91 RESOLUTION CALLING FOR CONSTRUCTION BIDS opened and examined at a public meeting so called and the 2 results of the bidding shall be reported to the Common Council 3 at the next regular meeting after the opening of the bids. 4 SECTION 4. The terms and conditions for bidding on 5 the Improvements for the Assessment District are set forth in 6 full in the Specifications and Contract Documents to be 7 approved by the Superintendent of Streets. Reference is 8 directed to the notice to be prepared, approved and identified 9 as follows: 10 II NOTICE INVITING BIDS (CONSTRUCTION) ASSESSMENT DISTRICT NO. 987 12 For all particulars as to bidding, the Notice Inviting Sealed 13 Bids (Construction) above referenced and approved by the 14 Superintendent of Streets shall govern and all terms and 15 conditions for bidding shall be pursuant to the Act. 16 SECTION 5. It is hereby determined that in the 17 event the contractor does not complete the work within the 18 time limit specified in the contract or within such time limit 19 as the Superintendent of Streets shall authorize, the 20 contractor shall pay as liquidated damages the amount or 21 amounts set forth in the Specifications and Contract Documents 22 for the Improvements, which provisions and amounts shall be 23 approved by the Superintendent of Streets.
