WHEREAS, pursuant to the provisions of the Cortese-Knox Local Government Reorganization Act of 1965, Division 3, commencing with section 56000 of the California Government Code, proceedings were initiated by the Common Council of the City of San Bernardino, to annex to the City of San Bernardino, certain contiguous uninhabited territory hereinafter described; and WHEREAS, the landowner in the proposed annexation has requested annexation to the City of San Bernardino to receive extended urban services; and WHEREAS, the Local Agency Formation Commission has set forth the following terms and conditions in its Resolution No. 2269 "Condition No. 1. The conducting authority for this proceeding shall be the City Council of the City of San Bernardino. "Condition No.2. The boundaries are approved as set forth in Exhibit "A" attached. "Condition No.3. The following distinctive short. form designation shall be used throughout this proceeding: LAFC 2584. "Condition No.4. Approval of this proposal is conditioned upon the initiation by the City of San Bernardino of a proposal for the annexation of the remaining island area created by this proposed annexation to the City.The condition shall be deemed fulfilled upon the issuance of a Certificate of Filing for the subsequent proposal. Upon completion of Condition No.4 above, 3 the City, as conducting authority, is authorized to proceed without notice, 4 hearing or election with 100~ landowner consent. 5 "Condition No.6. Included in the City's resolution 6 7 8 9 10 11 12 depicting final action shall be the detachment from County Service Area 38 and County Service Area 70 without split of assets or liabilities. "Condition No.7. The date of issuance of the Certificate of Completion shall be the effective date of this annexation. " BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION__~. That the City elects to proceed without hearing, as 13 authorized by LAX'CO Resolution No. 2269 as a result of 100~ of the property 14 owners within the proposed area are in consent of the annexation. 15 SECTION 2. Said territory herein described as Annexation No. 347 16 designated as LAFCO 2584, is hereby annexed and incorporated in and made a 17 part of the City of San Bernardino. 18 SECTION 3. The territory herein referred to as being annexed to 19 the City of San Bernardino is more particularly described in the Exhibit 20 "A", attached hereto and incorporated by reference as though fully set forth 21 in length. 22 SECTION 4. The above described territory will be subject to 23 taxation equally with the property within such municipal corporation. 24 SECTION 5. The regular County Assessment Roll is utilized by the 25 City of San Bernardino. 26 SECTI9N~.
