RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO MODIFYING FEES
FOR USE OF BUILDINGS, SPORTS FACILITIES, PARK AND RECREATION
FACILITIES, ALCOHOL USE PERMITS, PARKS AND PARKING LOTS,
EQUIPMENT AND SERVICES, AND STURGES AUDITORIUM AND
ESTABLISHING A TRUST FUND ACCOUNT TO BE DESIGNATED THE
"STURGES AUDITORIUM REPLACEMENT ACCOUNT," AND REPEALING
RESOLUTIONS 80-441, 86-316, 86-408, 87-111, 88-307, 88-480 AND
89-500, AND AMENDING RESOLUTION 83-201.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
Findinqs
The Mayor and Common Council
hereby find:
A. Hearing has been held by the Mayor and Common
Council pursuant to the provisions of Government Code section
54990, et seq., to consider the levy of new and additional
fees and service charges for various services provided by the
Parks, Recreation and Community Services Department, and for
uses of certain buildings, facilities, and equipment, which
hearing was held following public notice published in a
newspaper of
general circulation
in the
city of San
Bernardino.
B. None of the proposed increases exceed the rctual
cost of providing such services and facilities, and, for those
services which are not completely paid for by the proposed
fees, the additional expense to the city of providing the
services shall be borne by the general fund of the city of San
Bernardino.
C. The proposed fees and charges are reasonable and
necessary to enable the City of San Bernardino to more nearly

Public parks and recreation
SECTION 2.
buildings and swimming pools, under the jurisdiction of the
Parks, Recreation and Community Services Department, are
public property and as such are available for use by any
in
accordance with
the
following
person
or persons
specifications and as deemed appropriate by the Director.
SECTION 3. Procedure
The facilities and equipment
shall be used only for those meetings and activities pursuant
to City Municipal Code 12.80. Any person, persons, or groups
of persons desiring the use of any facilities or equipment
shall make application on forms provided by the Parks,
Recreation and Community Services Department and shall provide
such additional information as may be required to assure
compliance with City Municipal Code 12.80.
SECTION 4. Cancellations. Cancellations of meetings
and activities may occur twenty-four (24) hours prior to
scheduled use of facilities or equipment without forfeiting
any fees and/or deposits collected by the Department. In the
event of cancellation by the Department, notice will be given
as far in advance of the scheduled use as is possible under
the circumstances.

E. Priority of Use
The priorities of use shall be

Department sponsored activities.

Department co-sponsored activities.

youth-service

organizations
located permanently in and serving the City
of San Bernardino and tax supported groups.
4. Civic and social groups (resident and non
profit) .

commercial) .

Groups in Category 1 and 2 shall pay no fee.
G.
Non-profit, youth-serving organizations located
permanently in and serving the City of San Bernardino are
those organizations whose principal purpose is to provide a
service or program to participants, generally under the age
of 18, of which at least fifty-one percent
(51%) reside in
the City of San Bernardino. Groups in this classification
shall pay no fee for use of outdoor athletic facilities.
H. A non-residency surcharge of ten percent (10%)
for all facility or equipment rentals, class registration
fees and excursion fees (not to exceed $10.00 on excursions)
and a five dollar ($5.00) per non-resident surcharge for
adults sports programs and art display programs shall be
charged.
I. The Mayor and Common Council may exempt non-
profit associations and corporations organized primarily for
patriotic, civic betterment or charitable purposes or any
local civic or charitable organization
from the
foregoing
rates and fee schedule
for the
use of
park and
recreation
buildings and facilities upon a finding that the rental fee

would create a financial hardship jeopardizing the activity
or event planned for such use and that the activity or event
will be of unusual benefit to the residents of the City and
should be supported with pUblic funds.
The word 'local' as
used herein is defined
to mean an organization whose
membership is comprised of
fifty one percent (51%) of city
residents.
J. As a condition of exemption, the Mayor and Common
Council
may require that the association, corporation,
organization or group seeking exemption perform services or
provide labor beneficial to the City or its residents.
SECTION 6. Refundable Deposit. Refundable deposits
held pursuant to this resolution may be refunded in full or
in part within fourteen (14) days after completion of the use
period.
No refund shall be made until the using party or
group has secured a signed inspection and release form from
the appropriate facility manager, and delivered this executed
release form to the Parks, Recreation and Community Services
Department.
Deductions for any damages to the facility or
for clean up and repairs shall be made from the said deposit
by City.

Utilization of City Employees

During
any event when a City employee or employees are required to
be present for the purposes of clean up, monitoring, etc., a
fee shall be paid equivalent to the total cost of said
employees.
SECTION 8. Trust
Fund Account
There is hereby
9 established a trust fund account to be designated the
10 "Sturges Auditorium Replacement Account... Of the fees
11 established for Sturges Auditorium in section 5. of this
12 resolution, $150.00 of the first hour operational cost, and
13 $28.00 of each additional hour operational cost shall be
14 deposited into the Sturges Auditorium Replacement Account.

SEc'rrON 9. Repeal and Amendment of Pri.or Resolution
16 Resolutions 80-441, 86-316, 86-408, 87-111, 88-307, and 89-
17 500 are hE,reby repealed. To the extent that this resolution
18 affects fees in Resolution 83-201, said resolution is hereby
19 amended and modified in accordance herewith.
