HomeMy WebLinkAbout1991-007 , 1 2 RESOLUTION NO. ___9/-7 RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THAT LESS 3 THAN TWENTY FIVE PERCENT OF PROTESTS BY REGISTERED VOTERS AND PROPERTY OWNERS HAVE BEEN FILED AND ORDERING ANNEXATION NO. 346 (LAPCO 2621) FOR THE 4 TERRITORY GENERALLY LOCATED NORTH OF PACIFIC STREET, EAST OF STERLING AVENUE AND DETACHMENT FROM CSA 38, CSA 38 ZONE G, CSA 38 ZONE L, CSA 70, CSA 70 5 ZONE A AND CSA SL-1. 6 WHEREAS, lmrsuant to the provisions of the Cortese-Knox Local 7 Government Reorganization Act of 1985, Division 3, commencing with section 8 56000 of the California Government Code, proceedings were initiated by the 9 Common Council of the City of San Bernardino, to annex to the City of San 10 Bernardino, certain contiguous inhabited territory hereinafter described; 11 and 12 WHEREAS, landowners within the area proposed for annexation have 13 requested annexation to the City of San Bernardino to receive extended urban 14 services; and 15 WHEREAS, the Local Agency Formation Commission has set forth the 16 following terms and conditions in its Resolution No.2285: conducting authority for this 17 "Condi tion No. 1. The 18 proceeding shall be the City Counci 1 of the City of San Bernardino. 19 "Condition No.2. The boundaries are approved flS set forth 20 in Exhibit "A" attached. 21 "Condition No.3. The following distinctive short form 22 designation shall be used throughout this proceeding: LAPC 2621. 23 "Condition No.4. The conducting authority is required to 24 provide notice of its hearing in accordance with the provisions of 25 Government Code Section 57025. 26 "Condition No.5. The date of issuance of the Certificate of 27 Completion shall be the effective date of this annexation. That pursuant to Section 57050 of the California Government Code, a hearing was held on the day, and at the time and place as set forth hereinabove, Clnd protests were filed and received by less than twenty-five percent (25'l>) of the registered voters residing in the 18 territory proposed for annexation and protests were tiled and received by less than twenty-five percent (25'l>) of the property owners owning less then twenty-five percent (25'l>) of the total assessed value of the area proposed 21 22 for annexation, by the conclusion of said hearing. SECTION 2. Said territory herein described as Annexation No. 346 23 24 designated as LAFCO 2621, is hereby annexed and incorporated in and made a part of the City of San Bernardino. 25 SECTION 3. The territory herein referred to as being annexed to 26 the City of San Bernardino is more particularly described in the Exhibit 27 "A", attached hereto and incorporated by reference as though fully set forth 28 in length. 11-20-90 :2 RESOLCTIOK DETER~I~I~G PROTESTS AND ORDERI~G ANNEXATION NO. 346, \ORTq or PACIFIC STREEJ', EAST OF STERLING AVENUE. 1 SECTION 4. The above described territory will be subject to 2 taxation equally with the property within such municipal corporation. 3 SECTION 5. The regular County Assessment Roll is utilized by the 4 City of San Bernardino. 5 SECTION 6. The property herein annexed is declared to be a part 6 of Ward 7 and the boundaries of Ward 7 are hereby altered to include said 7 annexed territory, and has a designated land use of RS (Residential Urban), 8 and RMH (Residential Medium High), more particularly shown on the Map of 9 the City of San Bernardino General Plan as it currently exists. 10 SECTION 7.
