HomeMy WebLinkAbout1992-469 JI .~'. .. 1 2 RESOLUTION NO. 92-469 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING A 3 SIDE LETTER TO ARTICLE VI, SECTION 1, OF MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SAN BERNARDINO AND 4 EMPLOYEES IN THE POLICE SAFETY EMPLOYEES' BARGAINING UNIT OF THE CITY OF SAN BERNARDINO REPRESENTED BY THE SAN BERNARDINO 5 POLICE OFFICERS' ASSOCIATION (SBPOA). 6 7 WHEREAS the designated representatives of the Mayor and Common Council met and conferred in good faith with 8 representatives of SBPOA, representing the unit of Police 9 Safety permanent employees of the city of San Bernardino in 10 accordance with the provisions of Government Code Sections 11 3500, et seq., to discuss a proposed amendment to the 12 13 current Memorandum of Understanding (MOU); 14 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 15 16 SECTION 1: The Mayor and the Director of Personnel are 17 hereby authorized and directed to execute on behalf of said 18 city a Side Letter to Article VI, Section 1, of the Police 19 Safety Employees' Memorandum of Understanding, regarding 20 further implementation of a 4/10 work schedule, a copy of 21 which is attached hereto and incorporated herein marked 22 Exhibit "A. PENMAN 23 city Attorney 24 By: rLt"rV" '/ fc'!-,t/,v<<'~ ~: () 27 28 2 of 2 ~'Q.G ~~.,-\I..~ SIDE LETTER TO ARTICLE VI, SECTION 1, OP THE POLICE SAFETY EMPLOYEES' MEKORANDtJK OP UNDERSTANDING This letter sets forth the agreement made on November 18, 1992, between the City and San Bernardino Police Officers' Association relative to a 4/10 work schedule to commence November 30, 1992, to include the Investigative Unit, Detective Bureau, Vice/Narcotics, Sergeant in ID Detective, Detectives in Traffic, Intelligence and Internal Affairs and DARE. Extension of the 4/10 plan will be based on evaluation by the Chief of Police of such factors as: sick leave usage, number of employee injuries and sustained levels of productivity. The 4/10 plan may be extended to other sworn units. In the event of emergency conditions or special assignments, sworn personnel working the 4/10 schedule may have to revert to another work schedule. Special assignments might include task forces, training sessions, and long-term undercover assignments. Any request by the San Bernardino Police Officers' Association or the Chief of Police to change a unit's work schedule will require 30 days' advance notice and a meet and confer session prior to implementation, excluding emergency situations and special assignments. The above agreement is permissible under the terms and conditions of the Police Safety Employees' MOU.
