HomeMy WebLinkAbout1992-461 RESOLUTION NO. 92-461 1 2 3 4 5 RESOLUTION OF THE CITY OF SAN BERNARDINO TO ADOPT THE NEGATIVE DECLARATION AND TO ADOPT SPECIFIC PLAN NO. 92-01, UNIVERSITY BUSINESS PARK. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. RECITALS A. WHEREAS, the Mayor and Common Council adopted the General 6 Plan for the city of San Bernardino by Resolution No. 89-159 on 7 June 2, 1989; and 8 B. WHEREAS, the General Plan made provisions for the 9 establishment of Specific Plan No. 92-01 and Negative Declaration 10 11 12 13 14 15 16 17 18 19 for University Business Park (hereafter "Specific Plan"); and C. WHEREAS, a Specific Plan for the development of the 70.57 acres west of Interstate 215, north of University Parkway, east of Georgia Boulevard and south of Saratoga Boulevard has been drafted for the Mayor and Common Council's consideration. The Specific Plan includes General Plan Amendment No. 92-09, which will change the General Plan designation from CG-1, Commercial General and IL Industrial Light to UBP-1, UBP-2 and UBP-3, University Business Park 1, 2 and 3 for the area. General Plan Amendment No. 92-12 will amend the General Plan Land Use Map to reflect that change and 20 to outline the boundary of the specific Plan area. Reference to 21 the Specific Plan will be made. The Development Code Amendment, DCA 22 23 92-09 will implement the Specific Plan; and D. WHEREAS, the goals of the Specific Plan were formulated 24 through a series of meetings with the property owners, Development 25 26 27 28 staff and consultants; and IIII IIII IIII 1 E. WHEREAS, on September 17, 1992, the Development Review Committee recommended adoption of the Specific Plan; and F. WHEREAS, on November 4, 1992 the Planning Commission held a noticed public hearing to receive public testimony regarding the Specific Plan; and G. WHEREAS, on September 24, 1991, the Environmental Review Committee determined an Environmental Impact Report was unnecessary and recommended that a Negative Declaration be adopted, and comments were received from the Department of Transportation (CALTRANS) regarding a traffic study; and H. WHEREAS, the Planning Commission recommended that the Mayor and Common Council adopt a Negative Declaration, adopt General Plan Amendment No. 92-09, General Plan Amendment No. 92-12, Specific Plan No. 92-01, Development Code Amendment No. 92-09, based upon the Findings contained in the Planning Commission staff report, and this recommendation has been considered by the Mayor and Common council; 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 Common Council who have reviewed and considered the information in 25 the Negative Declaration prior to adopting University Business Park 26 Specific Plan. 27 Jill 28//// SECTION II. NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL HEREBY CERTIFY: (A) The Negative Declaration for Specific Plan No. 92-01, University Business Park, has been completed in compliance with the California Environmental Quality Act; (B) The Negative Declaration was presented to the Mayor and 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION III. FINDINGS BE IT FURTHER RESOLVED by the Mayor and Common Council of the City of San Bernardino that: (A) The Specific Plan is consistent with the General Plan in that the stated Goals and Objectives of both the General Plan and the Specific Plan provide for a diversity of regional and community serving uses, retain existing employment positions, achieve additional employment opportunities, eliminate the development of land uses within the park which may adversely impact the character of the City and the quality of life, provide for an interrelated pattern of compatible land uses, provide for the continued use, enhancement and new development of related commercial uses within the Business Park to serve the needs of the community, and with General Plan Policy 1. 7.20 which requires formulation of this Specific Plan; (B) The Specific Plan project area is physically suitable for the requested land use designations and the anticipated development in that the land uses and development were analyzed in the General Plan, the General Plan Environmental Impact Report, and the Environmental Negative Declaration for the Specific Plan, all which have determined the land uses and development desirable and appropriate for the area, all public services and infrastructure are available to the project area and any development permissible under the Specific Plan would not impact on these facilities; (C) The proposed plan will ensure development of desirable character which will be compatible with existing and proposed development in the surrounding neighborhood in that the design IIII 3 . 1 standards will ensure quality development and enhancement of 2 commercial and light industrial uses within the Business Park to 3 serve the needs of the community; and 4 (D) The proposed plan will contribute to a balance of land 5 uses so that local residents may work and shop in the community in 6 which they live in that the current condition of the University 7 Business Park includes many vacant parcels. When developed, the 8 park will attract an upscale commercial and light industrial 9 clientele to provide places for local residents to work and shop in 10 the community in which they live. 11 SECTION IV. 12 NOW THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the 13 Mayor and Common Council that the Environmental Negative 14 Declaration is adopted, and Specific Plan 92-01 is adopted. 15 Specific Plan No. 92-01, University Business Park is attached as Exhibit A and incorporated herein by reference. 16 17 18 19 an accompanying ordinance adopting Development Code Amendments 20 which implement the Specific Plan. 21 I I I I 22 IIII 23 IIII 24 IIII 25 IIII 26 27 28 SECTION V.
