HomeMy WebLinkAbout1992-454 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 RESOLUTION NO. 92-454 RESOLUTION OF THE CITY OF SAN BERNARDINO WAIVING THE MANDATED NINETY (90) DAY NOTIFICATION PERIOD RELATIVE TO RELINQUISHMENT OF STATE ROUTE 30, HIGHLAND AVENUE, FROM ARDEN AVENUE TO BOULDER AVENUE; BOULDER AVENUE, FROM HIGHLAND AVENUE TO FIFTH STREET; AND ROUTE 330, FROM ROUTE 30 TO NORTH CITY LIMITS, BY THE CALIFORNIA TRANSPORTATION COMMISSION. WITNESSETH: WHEREAS, State Route 30 (Highland Avenue), and a portion of Route 330 are no longer necessary components of the State Highway System, due to the completion of the Route 30 Freeway, from Arden Avenue to Route 1-10; and WHEREAS, the California Department of Transportation is proposing that State Route 30 (Highland Avenue) and a portion of Route 330, be relinquished to the City of San Bernardino; and WHEREAS, Section 8330.5 of the Streets and Highways Code mandates that the California Transportation Commission give a local agency ninety (90) days notification of a proposed relinquishment of a State Highway, unless the requirement for notification is waived by the local agency; and WHEREAS, the City of San Bernardino desires to waive the ninety (90) day notification period. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 21 COUNCIL OF THE CITY OF SAN BERNARDINO, AS FOLLOWS: 22 SECTION ONE: That the City of San Bernardino hereby 23 waives the ninety (90) day notification period, mandated by 24 Section 8330.5 of the Streets and Highways Code, relative to the 25 proposed relinquishment of State Route 30 (Highland Avenue and 26 Boulder Avenue, and a portion of Route 330. 27 28 SECTION TWO: That the proposed relinquishment of State Route 30 (Highland Avenue & Boulder Avenue) and a portion of 10/26/92 ~~ RESO: WAIVING THE NOTIFICATION PERIOD RELATIVE TO RELINQUISHMENT OF STATE ROUTES 30 AND 330. 1 Route 330, be accomplished by the California Transportation 2 Commission at the earliest possible date. 3 I HEREBY CERTIFY that the foregoing resolution was duly 4 adopted by the Mayor and Common Council of the City of San 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Bernardino at a meeting thereof, held on the reaular 7t-h day of Dp-r.p.mber , 1992, by the following vote, to-wit: Council Members: AYES NAYS ABSTAIN ABSENT ESTRADA x -- REILLY ~{ HERNANDEZ x MAUDSLEY " MINOR " POPE-LUDLAM " MILLER " i2.'--(;'~f.
