RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO STEINY AND COMPANY, INC. FOR TRAFFIC SIGNAL
MODIFICATIONS AND INTERCONNECT ON MILL STREET, FROM "K" TO "G"
STREETS.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
Steiny and Company, Inc. is the lowest
responsible bidder for:
Traffic Signal Modifications and
Interconnect on Mill Street, from "K" to "G" Streets, per Plan
No. 8136. A contract is awarded accordingly to said bidder for
the total amount of $49,444.00, but such award shall be effective
only upon the contract being fully executed by both parties. All
12 other bids, therefore, are hereby rejected. The Mayor is hereby
13 authorized and directed to execute said contract on behalf of the
14 City; a copy of the contract is on file in the office of the City
15 Clerk and incorporated herein by reference as fully as though set
16 forth at length.

SECTION 2. This contract and any amendment or modi fica-
18 tions thereto shall not take effect or become operative until
19 fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No
21 oral agreements,
amendments, modifications or waivers are
22 intended or authorized and shall not be implied from any act or
23 course of conduct of any party.

SECTION 3.
This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
