2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO FIXING AND DETERMINING THE FEES AND CHARGES TO BE CHARGED
3 FOR THE COLLECTION AND DISPOSAL OF REFUSE, AND REPEALING RESOLUTION
NO. 91-288 AND AMENDMENTS THERETO, AND PROVISIONS FOR AUTOMATED
4 RESIDENTIAL REFUSE COLLECTION.
5 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL
OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The fees and charges set forth herein shall apply
to refuse collection services provided by the city.
SECTION 2. A minimum sixty-five dollar ($65.00) deposit shall
be required for each new commercial refuse account.
Said deposit
must be paid prior to the City commencing refuse collection service.
This deposit shall be retained by the city and applied to any
closing bill upon termination of service. Any excess amount shall
be refunded.
SECTION 3. Collection and Disposal of Refuse - Sinqle Familv
Residences.
For collection and disposal of refuse, the owner or
authorized agent, of any single-family residential premises, or
portions, thereof, located within the territorial limits of the City
of San Bernardino, shall pay the following fee:

per month for regular twice per week curbside or alley
per month for two (2) times per week automated refuse
service plus $10.50 per month for each additional ni~ety(90) gallon

automated container requested.
City is to provide each residence
with one (1) ninety (90) gallon container for automated collection
only. Request(s) for additional container(s) must have approval of
property owner.
Service is implemented for approximately 14,000

1 single-family dwellings within the incorporated limits of the city
2 of San Bernardino. The specific routes are on file in the
3 Department of Publ ic Services.
4 SECTION 4. Collection and Disposal of Refuse - Multiple
5 Dwellinqs. Apartments. Etc. For collection and disposal of refuse,
6 the owner or authorized agent of any apartment house, court, mobile
7 home park, trailer court, duplex or other multiple dwelling unit
8 complex shall pay the following fees:

15 It shall be the duty of the Director of Public Services to
16 determine the number of units actually used, or capable of being
17 used, for housekeeping purposes and to adjust the assessment for
18 each use accordingly. In areas receiving automated residential
19 service, the City will provide one (1) ninety (90) gallon container
20 for every pair of dwelling units or fraction thereof.
21 SECTION 5. COLLECTION AND DISPOSAL OF REFUSE - SMALL
22 BUSINESSES. For collection of refuse the owner, or authorized agent
23 of any hotel, office building, restaurant, shop, store, hospital,
24 auto court, motel or other similar place shall pay the following
25 fees, based on the placement for collection of one (1) city-provided
26 ninety (90) gallon automated container in areas receiving automated

More than 5 units: $43.80 plus $7.50 each unit over 5.

9 SECTION 6. Collection and Disposal of Refuse utilizinq bins
10 and Hvdraulic Loadinq Equipment. (a) When the refuse collection
11 is performed by means of bins and city hydraulic loading equipment
12 the monthly fee shall be as follows for each collection per week.
13 A monthly rental fee shall be charged for the use of city-owned bins
14 and shall be in addition to the collection and disposal fee.

(b) All fees pursuant to this section shall be reviewed

periodically and, on the basis of findings, monthly fees shall be
adjusted to maintain conformance with the fee schedule set forth in
Subsection (a) above, except that monthly fees shall not be adjusted
to maintain conformance with the fee schedule set forth in relation
to temporary variations of refuse due to seasonal factors, where

1 such variations form the average do not extend beyond a three-month
2 period.
3 (c) When a city-owned bin is requested for use on a temporary
4 basis a special delivery charge of eighteen dollars ($18.00) shall
5 be made for each such bin, in addition to the regular monthly bin
6 rental fee; said monthly rental fee shall be prorated for the period
7 of such use, in increments of not less than one (1) week. A service
8 fee equal to twenty-five percent (25%) of the regular monthly
9 collection and disposal fee for the size of bins so-utilized shall
10 be charged for each time the bin is serviced, at intervals of not
11 less than two (2) weeks.
12 (d) When a city refuse collection crew documents a container
13 was unserviceable upon their arrival there will be no reduction in
14 charges nor will there be an in-lieu-of pickup made without
15 customer's authorization and a charge of twenty-five percent (25%)
16 of the regular monthly fee for the particular container.
17 SECTION 7. Collection and Disposal of Refuse utilizinq
18 Compaction-Type containers with a Capacity of 2 - 8 cubic yards.
19 When the service performed by the City is the collection and
20 disposal of refuse placed for collection in city approved compaction
21 type containers having a capacity from two (2) to eight (8) cubic
22 yards, the monthly fee, for one time per week collection, shall be
23 as follows:

6 SECTION 8. Collection and Disposal of Refuse utilizino Laroe
7 Compaction-Tvpe containers or Commercial DroP-Bodies.
8 (a) When the service performed by the City is the collection
9 and disposal of refuse placed for collection in city approved
10 compaction-type containers or commercial drop-bodies, having a
11 capacity of 10, 15, 20, 30, 35, or 40 cubic yards, the fee for each
12 time of collection shall be as listed below. Collection shall be
13 made at intervals of not less than two (2) weeks for dry wastes, and
14 at intervals of not less than one (1) week for wet or food-
15 containing wastes. A monthly rental fee shall be charged for the
16 use of City-owned containers and shall be in addition to the

2 for weight in excess of the above tonnage schedule, that charge
3 shall be a debt of the customer based on a tipping fee at the rate
4 of thirty-six dollars and sixty-five cents ($36.65) per ton and
5 shall be added as a pass through to the base fee due the City.
6 (c) Removal of tires or hard to handle material as defined by
7 the County Solid Waste Management Department shall be at the rate of
8 eighty-six dollars and sixty-five cents ($86.65) per ton Disposal
9 Fee plus seventy-five dollars ($75.00) Service Charge.
10 (d) In the event a city crew documents a container was
11 unserviceable upon their arrival, the customer will be assessed a
12 service fee at the rate of seventy-five dollars ($75.00) per attempt
13 to service container.
14 SECTION 9. The Director of Public Services, upon request, may
15 provide for the special collection and removal of refuse from any
16 place or premises at any time ("Specials"), in addition to or beyond
17 the regular collection service schedule, or in a manner different
18 from normal collection practice and procedures. The rate for any
19 such special service shall be eighty-eight dollars ($88.00) per hour
20 with a minimum charge of twenty-two dollars ($22.00).
21 SECTION 10. All fees and charges set forth in this resolution
22 shall be collected monthly.
23 SECTION 11. Any service for the collection and disposal of
24 refuse as set forth in this resolution may be discontinued by the
25 Director of Public Services if any fees or charges, as levied

1 herein, are not paid within ninety (90) days from the date said
2 assessment is billed.
3 SECTION 12. The Mayor and Common Council may exempt from the
4 fee provisions and charges of this resolution certain nonprofit
5 events in the public interest. The exemption shall be subject to
6 any conditions imposed by the Director of Public Services.
7 SECTION 13. The Director of Public Services may provide
8 collection and disposal service without charge in emergency
9 situations and when, in the opinion of the Director, such action is
10 necessary to correct fire hazards, or other conditions which present
11 an imminent threat to health and safety.
12 SECTION 14. Resolution No. 91-288 and amendments thereto and
13 any other resolution in conflict herewith are hereby repealed.
