HomeMy WebLinkAbout1992-178 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 92-178 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE DIRECTOR OF PARKS, RECREATION AND COMMUNITY SERVICES DEPARTMENT TO EXECUTE AN AGREEMENT WITH CATHOLIC CHARITIES, INC. DIOCESE OF SAN BERNARDINO, TO PROVIDE SENIOR AIDES TO CITY WORK SITES. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Director of Parks, Recreation and Community Services is hereby authorized and directed to execute on behalf of said City an agreement with the Catholic Charities, Inc. Diocese of San Bernardino, relating to the placement of senior aides at City work sites. A copy of said agreement is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. The authorization granted hereunder shall expire and be void and of no further effect if the agreement is not executed by both parties and returned to the office of the city Clerk within 60 days following effective date of the resolution. The Host ~ency agrees to provide a safe and healthful w:>rk site for each SeniOl: Aide, to prov ide adequate orientation and training necessary to perfotlll assigned job duties in accordance with a written job description, to provide additional training as opportunities occur, and, to the extent possible, to treat each Senior Aide as a regular member of the Host Jlgency staff. The Host ~ency agrees to consider each Senior Aide for regular enployment, either full-time or part-time, when vacancies occur in the Host ~ency staff or When new positions are created. The Host Jlgency \n'Iderstands that the maximum length of time that a Senior Aide may renain in the same job assigrment shall not exceed 24 months, except under limited circunstances which will be deteIIl\ined by the N:SC Senior AIDES Program. Moreover, the Host ~ency understands that the SponsOl: Agency reserves the right, following reasonable notice, to reassign any Senior Aide at any time that reassignment will increase the SeniOl: Aide's opportunities for training or unsubsidized enployment, or will otherwise serve the best interests of the Senior Aide, or will better support the goals and objectives of the Senior AIDES progr<lll. The Host ~ency agrees that no other national Title V project sponsor will be provided a work site while this Agreanent is in effect. The Host Jlgency agrees to abide by the hours and work schedules mutually agreed to for each Senior Aide and to provide properly prepared time sheets, periodic perfotlllance evaluations, and other required docunents. In addition, the Host Jlgency agrees and understands that each senior Aide will be required to attend periodic Senior AIDES Project meetings during regular working hours. [PP-l05/June 1987!Page 1 of 3] N:SC Senior AIDES Program Policy And Procedure Manual 105 105 SENIOR AIDES PROJECl'/R:lST AGm:Y ~ , The fbst ~ency agrees that the job to Iobich the Senior Aide is assigned is an increase in employment opportunities; will not result in the displacanent of =rently anplo~ w:>rkers or in a reduction in non- overtime hours of work, wages, or benefits; will not impair any existing contract for service or result in the substitution of the wages of the Senior Aide for other funds in connection with work which otherwise would be perfoIIlled; will not be a substitution for any existing federally assisted job; and will not be in a position which is the scme as or substantially the same as that occupied by any other person who is on lay-off. Further, the Host Agen:y agrees that it will not discriminate against a Senior Aide on the grounds of race, color, religiCX1, sex, national origin, or handicap. 'ttle fbst ~ency agrees to provide doc:unentation of in-kind contributions, if specified in an accompanying letter of agreanent. Further, it is understood by the fbst ~ency and the Sponsor ~ency that any contributiCX1, whether cash or in-kim, by the Host Agen:::y is purely voluntary and is not a condition for the assigm'lent of any Senior Aide. The Host Agen:::y certifies by this Agreement that it is a goverrmental agency or is a non-profit agency which is =rently certified as a section SOl (c) (3) organizatiCX1 under the Internal RevenlE Code. EUrther, if the fbst ~ency is certified as a Section 501 (c) (3) agency, a copy of that certification is attached or is on file with the Sponsor Agency and is still in effect. 'ttle fbst ~ency agrees to infotlll the Sponsor Agen:::y inmediately if the Section 501 (c) (3) certification is changed . 'ttle Sponsor ~ency agrees to recruit, enroll, and assign a Senior Aide or Senior Aides to the Host Agen:::y for the purpose of engaging in productive ccmmunity service anployment with duties and tasks as specified in a written job descriptiCX1. 'ttle Sponsor ~ency agrees to be responsible for all administrative and fiscal controls of the Senior AIDES Project and for paying wages and providing fringe benefits to each Senior Aide.
