Home My WebLink About1992-167 RESOLUTION NO. 92-167 1 2 RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COSTS OF 3 ABATEMENTS AND IMPOSING LIENS ON CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE 4 COSTS OF THE ABATEMENT OF PUBLIC NUISANCES. (Building Abatements) 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 6 SAN BERNARDINO AS FOLLOWS: 7 8 9 SECTION 1. The City of San Bernardino, pursuant to its authority under San Bernardino Municipal Code Chapter 15.28 and other laws, did lawfully cause public nuisance abatements 10 on the real property described in Exhibit "A", attached hereto 11 and incorporated herein by reference as though fully set 12 forth. The last known owners of record as to each such parcel 13 are also specified in Exhibit "An. 14 Due notice was given to the person or persons having an 15 interest in said property and a hearing was held by the Board 16 of Building Commissioners to hear protests and to assess the 17 costs of said abatement on said property. The Board of 18 Building Commissioners has entered its order determining the 19 costs to be reasonable and proper and imposing a lien upon the 20 land involved. Notice of the right to appeal to the Mayor and 21 Common Council has been issued to all affected property 22 holders. The Board of Building Commissioners now requests 23 that the Mayor and Common Council confirm the imposition of 24 the liens. 25 26 27 28 1 20 21 I 1 2 3 Resolution of the City of San Bemardino confirming costs of abatements and imposing liens... (building abatements) SECTION 2. The matter having now come before the Mayor 4 and Common Council for confirmation of the imposition of the 5 liens imposed, the following costs are found to have been duly 6 incurred by the City pursuant to proceedings under said 7 provisions of the San Bernardino Municipal Code and the final 8 statements of costs on file with the City Clerk are hereby 9 confirmed and adopted as special assessments against the 10 properties listed in Exhibit "A" hereto. 11 12 SECTION 3. If said sum is not fully paid to the City 13 Clerk, City Hall, San Bernardino, within five (5) days after 14 mailing a notice to the person or persons having an interest 15 in' said property informing said person or persons of the 16 adoption of this resolution as to any such individual parcel, 17 then said sum shall be and become a lien on said property 18 pursuant to said Municipal Code provisions and applicable laws 19 and shall be collected as a special assessment thereon. SECTION 4. In the event said sum is not paid as 22 hereinabove provided, the City Clerk is hereby directed to 23 file a certified copy of this resolution with the Auditor of 24 the County of San Bernardino, State of California, directing 25 that said sum be entered as lien charges against said property 26 as it appears on the current assessment rolls, to be collected 27 28 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution of the City of San Bernardino confirming costs of abatements and imposing liens... (building abatements) at the same time and in the same manner, subject to the same penalties and interest upon delinquencies, as the general taxes for the City of San Bernardino are collected. The City Clerk shall present for recording appropriate notices of the imposition of these liens with the County Recorder.
