HomeMy WebLinkAbout1992-155 . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 92-155 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING INTENTION TO ORDER THE INSTALLATION OF CERTAIN IMPROVEMENTS IN A PROPOSED ASSESSMENT DISTRICT; DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY BENEFIT; DESCRIBING THE DISTRICT TO BE ASSESSED TO PAY THE COSTS AND EXPENSES THEREOF; AND PROVIDING FOR THE ISSUANCE OF BONDS IN ASSESSMENT DISTRICT NO. 1003 THE COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The public interest and convenience require, and it is the intention of this body, pursuant to the provisions of Division 12 of the Streets and Highways Code of the State of California (the "Munici- pal Improvement Act 1913"), to order the installation of certain public improvements, together with appurtenances and appurtenant work, in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 1003 (hereinafter referred to as the "Assessment District"). DESCRIPTION OF IMPROVEMENTS A. The installation and financing of certain public improvements generally described as street improvements, including paving, curb and gutter, street lights, storm drain improvements, and sewer and water improvements, together with appurtenances and appurtenant work, to serve and benef it propert ies located wi thin the boundar ies of the Assessment District. B. Said streets, rights-of-way and easements shall be shown upon the plans herein referred to and to be filed with these proceedings. c. All 0 f said work and improvements are to be constructed at the places and in the particular locations, of -the forms, sizes, dimensions and materials, and at the lines, grades and elevations as shown and delineated upon the plans, profiles and specifications to be made therefor, as hereinafter provided. 04/27/92 RESOLUTION " MAKING APPONTMFNTS AND APPROVING AGREEMENT FOR SPECIAL . That the place for recordation of the assessment 2 roll and diagram shall be in the Office of the Superintendent of streets, 3 and said assessment roll and diagram, upon recordation, shall be kept as a 4 permanent record. 5 SECTION 4. That the SAN BERNARDINO SUN is hereby designated as 6 the newspaper for all publications as required by law and as necessary for 7 completion of this Assessment District. 8 SECTION 5. That GFB-FRIEDRICH & ASSOCIATES, INC. is hereby 9 appointed the Assessment Engineer for said proceedings, and said Assess- 10 ment Engineer shall perform all of the duties and responsibilities as set 11 forth by law as they relate to said Assessment District. 12 SECTION 6. That BROWN, DIVEN & HENTSCHKE, Attorneys at Law, is 13 hereby appointed to act as Bond Counsel for the purposes of preparing 14 proceedings and issuing an approving opinion attesting to the validity of 15 the proceedings and the enforceability of the bonds. 16 SECTION 7. That the Acquisition/Financing Agreement, as 17 submitted for the referenced Assessment District, is hereby approved, and 18 execution is authorized to be made by the Mayor and City Clerk. 19 SECTION 8. That this legislative body hereby establishes a 20 special IMPROVEMENT FUND designated by the name and number of the 21 Assessment District, and into said fund shall be placed all proceeds from 22 the sale of bonds and cash collections. In order to expedite the 23 improvements or acquisition under these proceedings and as authorized by 24 law, funds from any available source may be transferred into said special 25 fund.
