HomeMy WebLinkAbout1992-083 - 1 2 3 4 5 6 7 8 Resolution No. 92-83 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING THE MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND THE MITIGATION REPORTING/MONITORING PROGRAM, AND ADOPTING PUBLIC WORKS PROJECT NO. 91-09B, THE SOURCE REDUCTION AND RECYCLING ELEMENT AND HOUSEHOLD HAZARDOUS WASTE ELEMENT. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Recitals (a) This Resolution and Public Works Project 91-09B, the 9 Source Reduction and Recycling Element and the Household 10 Hazardous Waste Element, were prepared pursuant to the California 11 Integrated Waste Management Act of 1989 (AB 939) (Public 12 Resources Code Section 40000 et seq.) and Title 14 of the 13 California Code of Regulations, Chapter 9, Division 7. 14 (b) The first of two noticed public hearings to receive 15 public testimony on the elements of Public Works Project No. 91- 16 09B was held by the Mayor and Common Council on October 7, 1991. 17 (c) The elements of Public Works Project No. 91-09B were 18 reviewed by the Solid Waste Advisory Task Force during a 45 day 19 review period from September 9, 1991 through October 17, 1991, 20 and comments received were addressed in the final draft. 21 (d) The elements of Public Works Project No. 91-09B were 22 reviewed by the California Integrated Waste Management Board 23 24 25 26 27 28 during a 45 day review period from September 9, 1991 through October 17, 1991, and comments received were addressed in the final draft. (e) The final draft elements of Public Works Project No. 91-09B were reviewed by the Final Review Committee of the Solid Waste Advisory Task Force during a 15 day review period. The February 21, 1992 1 .. 1 Solid Waste Advisory Task Force's endorsement has been considered 2 by the Mayor and Common Council. 3 (f) In compliance with the California Environmental Quality 4 Act (Public Resources Code Sections 21000 et seq.), an Initial 5 Study was prepared on November 8, 1991, and reviewed by the 6 Environmental Review Committee who determined that Public Works 7 Project No. 91-09B would not have a significant effect on the 8 environment and therefore, recommended that a Mitigated Negative 9 Declaration be adopted. (Attached as Exhibit I and incorporated 10 herein by reference.) 11 (g) The proposed Mitigated Negative Declaration received a 12 30 day public review period from December 16, 1991 through 13 January 17, 1992 and all comments relative thereto have been 14 reviewed by the Mayor and Common Council in compliance with the 15 California Environmental Quality Act (CEQA) and local 16 regulations. 17 (h) A Mitigat1.on Reporting/Monitoring Program was prepared 18 on February 19, 1992, and included in the Proposed Mitigated 19 Negative Declaration. (Attached as Exhibit II and incorporated 20 herein by reference.) 21 (i) The Mayor and Common Council held a second noticed 22 public hearing to receive public testimony and fully reviewed and 23 cons1.dered proposed Public Works Project No. 91-09B, the proposed 24 Mitigated Negative Declaration, and the Mi tigation 25 Reporting/Moni toring Program, the Public Services Department 26 Refuse Division Staff Report, and all public comments on March 2, 27 1992. 28 / / / February 21, 1992 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 2. Negative Declaration NOW, THEREFORE BE IT RESOLVED, FOUND AND DETERMINED by the Mayor and Common Council that the proposed Public Works Project No. 91-09B will have no significant effect on the environment, and the attached Mitigated Negative Declaration and Mitigation ReportinglMonitoring Program heretofore prepared by the Environmental Review Committee as to the effect of this proposed project is hereby ratified, affirmed and adopted. SECTION 3. Adoption of Elements BE IT FURTHER RESOLVED by the Mayor and Common Council of the City of San Bernardino that it does hereby adopt Public Works Project No. 91-09B, the Source Reduction and Recycling Element and the Household Hazardous Waste Element. (Attached as Exhibit III and incorporated herein by reference.) SECTION 4. Submittal of Elements To County The Public Services Department is hereby directed to submit a copy of the Source Reduction and Recycling Element and the Household Hazardous Waste Element to the County of San Bernardino for incorporation into the Countywide Integrated Waste Management Plan. SECTION 5. Notice of Determination The Planning and Building Services Department is hereby directed to file a Notice of Determination with the County Clerk of the County of San Bernardino certifying the City's compliance with CEQA in preparing the Mitigated Negative Declaration.
