RESOLUTION NO. 92-40
RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS INTENTION
TO ORDER THE VACATION OF A PORTION OF THE NORTH/SOUTH ALLEY LYING WEST OF
"E" STREET, BETWEEN MAGNOLIA AVENUE AND EVANS STREET AND RESERVING EASEMENTS
FOR PUBLIC UTILITIES THEREIN.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1.
That the Mayor and Common Council of the City of San
Bernardino hereby declare their intention to order the vacation of a portion
of the North/South alley lying West of "E" Street, between Magnolia Avenue
and Evans Street, described as follows:

in Book 3 of Maps, Page
of San Bernardino, State

That portion of Block C
plat thereof, recorded

California, described as

Beginning at the Northeast corner of Lot 6 of said Block
B; thence South along the East line of said Lot 6 to the
Southeast corner of said Lot 6; thence East along the
Easterly prolongation of the South line of said Lot 6 to
a point on the West line of Lot 3 of said Block C; thence
North along said West lines of Lots 3, 2, and 1 to the
Northwest corner of said Lot 1; thence West along the
Westerly prolongation of the North line of said Lot 1 to
the Point of Beginning.
That the Mayor and Common Council of the City of
San

Bernardino,
in vacating the above described portion of said alley,
elect
20 to proceed under and in accordance with the provisions of the "Public
21 Streets, Highways and Services Vacation Law", being Division 9, Part 3, ot
22 the Streets and Highways Code of the State of California.

SECTION 3.
That the hour of 10:00 A.M. on the 2nd day of March,
24 1992, in the Council Chamber of the City Hall, San Bernardino, California,
25 be, and the same hereby is fixed as the time and place when and where all
26 persons interested in or objecting to the proposed vacation may appear

STREET/ALLEY VACATION:
PORTION OF NORTH/SOUTH ALLEY WEST OF "E" STREET,
BETWEEN MAGNOLIA AVENUE AND EVANS STREET.
1 hereinbefore described portion of said streets, reference is made to that
2 map marked "Plan No. 7950", approved November 4, 1991, on file in the office
3 of the City Clerk of said City.
4 SECTION 4. Nothing in this Resolution shall in any way affect or
5 disturb any existing easements for public utility purposes belonging either
6 to the City of San Bernardino or to any public utility and there is hereby
7 reserved for future general public utility purposes and for this City an

easement
reasonably necessary to locate such public utility facilities
over, in, under or across the real property hereinabove described and to
replace or renew such facilities.
There are
use, maintain,
repair,
hereby specifically reserved for Southern California Edison and Comcast
Cablevision, easements over the entire portion of the alley being vacated,
to construct, place, operate, inspect, maintain, repair, replace and remove
14 such aerial and underground electrical and television transmission struct-
15 ures as the companies may from time to time require, consisting of poles,
16 anchors, wires, cables, conduits, manholes, markers and necessary fixtures
17 and appurtenances. Said easements include rights of ingress and egress.

SECTION 5. That the City Engineer of the City of San Bernardino is

to cause Notices of Street Vacation to

20 required by the Public Streets, Highways and Services Vacation Law.

SECTION 6. That the City Clerk shall certify to the adoption of
22 this Resolution of Intention and shall cause the same to be published once a
23 week for two successive weeks in The Sun, a newspaper published and
24 circulated in the City of San Bernardino, prior to the date of the above
25 public hearing.
