HomeMy WebLinkAbout1992-019 1 2 3 4 5 6 7 8 9 10 11 12 13 RESOLUTION NO. 92-19 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, MAKING FINDINGS AND DETERMINATIONS AS TO THE BENEFIT TO THE STATE COLLEGE REDEVELOPMENT PROJECT AREA OF ASSISTING IN THE REHABILITATION OF A LOW AND MODERATE INCOME RENTAL HOUSING PROJECT WHEREAS, the City of San Bernardino, California (the "city"), is a municipal corporation and a charter city duly created and existing pursuant to the Constitution and the laws of the State of California; and WHEREAS, the Community Development Commission of the City of San Bernardino (the "Commission") on behalf of the Redevelopment Agency of the City of San Bernardino (the 14 "Agency"), is a redevelopment agency, a public body, corporate 15 and politic of the State of California, organized and existing 16 community Redevelopment Law pursuant to the (Part of 1 17 Division 24) 18 19 20 commencing with Section 33000 of the Health and Safety Code of the State of California (the "Act"); and WHEREAS, the City and the Commission have previously 21 22 23 24 25 26 approved and adopted the Redevelopment Plan for the State College Redevelopment Project (the "State College Redevelopment Plann); and WHEREAS, pursuant to Section 33334.2(g) of the Act, the Agency may, with the consent of the Mayor and Common Council of 27 the City (the "Council"), use moneys in its Low and Moderate 28 III - 1 - 1 2 3 4 5 6 7 WHEREAS, it is in the interests of the present 8 landowners within the project area subject to the State College 9 Plan (hereinafter referred to as the "Project 10 ea") and the residents, both within the Project Area and within 11 he city generally, that the Agency assist in using moneys in its 12 ow and Moderate Income Housing Fund attributable to the Project 13 rea to fund the rehabilitation of a ninety-two (92) unit low and 14 oderate income residential apartment building generally located 15 at 2085 North Central Avenue ("the Project"); and 16 17 WHEREAS, the Project is to be undertaken in a 18 neighborhood which, although is some distance from the Project 19 rea, will allow greater utilization of the existing low and 20 oderate income housing stock available within the city and, as 21 such, will provide a residential base to low and moderate income 22 families who may rely on the Project Area for employment 23 opportunities and the provision of services; and 24 25 WHEREAS, the undertaking of the Project will assist in 26 alleviating low and moderate income housing needs within the city 27 generally and thereby will alleviate housing needs within the 28 Project Area to the extent the Project Area is unable to provide - 2 - ncome Housing Fund for projects which are located outside of the oundaries of a redevelopment project area if the Agency and the ouncil determine that the use of such funds will be of benefit o the redevelopment project area and such determination by the gency and the Council shall be final and conclusive; and 1 adequate low and moderate income housing and this will in turn 2 ensure the health, safety and welfare of residents and occupants 3 of the Project Area; and 4 5 WHEREAS, in order to promote the city's health, safety 6 and welfare, it is important that the Project be financed in 7 order to ensure the orderly development of the Project Area and 8 within the city generally; and 9 10 WHEREAS, it is appropriate at this time for the Council 11 to make certain findings and determinations and take certain 12 action with respect to the undertaking of the Project. 13 14 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 15 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 16 17 SECTION 1. The Recitals hereinabove are true and 18 correct and are incorporated herein by this reference. 19 20 SECTION 2. The Council approves the use by the 21 Agency of moneys from its Low and Moderate Income Housing Fund 22 attributable to the Project Area to be used for the 23 rehabilitation of the Project which Project will be of benefit to 24 such Project Area and other neighborhoods within the city for the 25 reasons set forth in the Recitals hereinabove. The Council 26 further finds and determines that no other reasonable means of 27 financing the undertaking of the Project is presently available 28 to the City and that the city and the Agency require the use of - 3 - 1 2 3 4 5 6 7 8 9 10 11 SECTION 4. The City Clerk is hereby authorized and 12 directed to cause this Resolution to be transmitted to the Agency 13 for consideration in connection with appropriate action by that 14 body. 15 I I I 16 I I I 17 III 18 I I I 19 I I I 20 I I I 21 I I I 22 III 23 III 24 III 25 III 26 III 27 III 28 III revenues generated from the Project Area in order to fund the undertaking of the Project. SECTION 3. The provision of moneys from the Agency's Low and Moderate Income Housing Fund attributable to the Project Area will improve housing opportunities for low and moderate income households within the City generally which will in turn help alleviate housing need and eliminate blight within such Project Area and other areas of the city. - 4 - 1 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, MAKING FINDINGS AND DETERMINATIONS AS TO 2 THE BENEFIT TO THE STATE COLLEGE REDEVELOPMENT PROJECT AREA OF SSISTING IN THE REHABILITATION OF A LOW AND MODERATE INCOME 3 RENTAL HOUSING PROJECT 4 The findings and determinations herein SECTION 5. 5 shall be final and conclusive.
