HomeMy WebLinkAbout1993-402 1 RESOLUTION NO.93-402 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO MAKING FINDINGS AND DETERMINATIONS AS TO THE 3 BENEFIT OF UNDERTAKING CERTAIN BLIGHT REDUCING ACTIVITIES FOR THE STATE COLLEGE REDEVELOPMENT PROJECT AREA OF THE SAN BERNARDINO 4 REDEVELOPMENT AGENCY. 5 WHEREAS, the City of San Bernardino, (the "City"), is a 6 municipal corporation and a charter city duly created and existing 7 pursuant to the Constitution of the laws of the State of 8 California; and 9 WHEREAS, the Community Development Commission of the City of 10 San Bernardino (the "Commission") on behalf of the Redevelopment 11 Agency of the Ci ty of San Bernardino (the "Agency" ), is a 12 13 14 15 16 17 18 19 20 redevelopment agency, a public body, corporate and politic of the State of California, organized and existing pursuant to the Community Redevelopment Law (Part I of Division 24) commencing with Section 3000 of the Health and Safety Code of the State of California (the "Act"); and WHEREAS, the State College Redevelopment Project Area ("Area") was created by Ordinance No. 3067 dated April 27, 1970; and WHEREAS, the Agency may, in furtherance of its redevelopment 21 purposes, undertake redevelopment projects either within or 22 23 24 25 26 27 28 without redevelopment project areas of the Agency to the extent that it determines that such proj ects are of benefit to the project areas of the Agency; and WHEREAS, the Agency may undertake various blight reducing redevelopment activities (the "Blight Reducing Activities") including but not limited to the partial funding of water facility public improvements, which Blight Reducing Activities are located DAB/js [Findings.Res] 1 September 29. 1993 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 93-402 . 1 outside the boundaries of the Project Area of the Agency if the 2 Agency determines; (1) that such Blight Reducing Activities are 3 of benefit to the state College Redevelopment Project Area of the 4 Agency or the immediate neighborhoods in which the project is and 5 ( 2 ) that no other reasonable means of financing such Blight 6 Reducing Activities is available to the community; and 7 WHEREAS, the undertaking of the Blight Reducing Activities 8 will benefit and promote the development of the State College 9 Redevelopment Project Area within the City to the extent that it 10 will make such project area more desirable for industrial, commercial or residential development which in turn will assist in the elimination of blight within such area; and WHEREAS, in order to promote the City's health, safety and welfare and ensure the orderly development of the Agency's State College Redevelopment Project Area, it is important that the Blight Reducing Activities be financed by the Agency; and WHEREAS, it is appropriate at this time for the Mayor and Common Council of the City (the "Council") to make certain the financing of the Blight Reducing Activities. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The recitals hereinabove are true and correct and are incorporated herein by this reference. SECTION 2 . The Council consents to the payment by the Agency of the costs of the Blight Reducing Activities in order to implement the State College Redevelopment plan of the Agency for the reasons set forth in the Recitals hereinabove.
