RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
1 BERNARDINO, CALIFORNIA, APPROVING THE SITE IDENTIFICATION AND
2 DESCRIPTION FOR THE MITSUBISHI CEMENT CUSHENBURY SANITARY LANDFILL
FACILITY FACILITY IDENTIFICATION # 36-AA-0074

WHEREAS, the facility under consideration is an existing,
4 refuse disposal facility operating under permit since 1979; and
5
WHEREAS, the operating Solid Waste Facilities Permit (SWFP),
6 originally issued on January 12, 1979 is currently outdated; and
7
WHEREAS,
the

WHEREAS, said SWFP is only issued for the revision and the

WHEREAS, the SBCo SWMD has also completed the site
16 Identification and Description of the project for submission to the
17 city of San Bernardino, a copy of which is attached and marked

Exhibit "A"; and

WHEREAS, this facility can continue to provide the SBCo SWMD a
ethod of disposing of municipal solid wastes, inert wastes, and
21 non-hazardous solid wastes; and

WHEREAS, Public Resources Code S50000 requires that the "site
Identification and Description" of a new or changed (defined as a
solid waste
significant increase in the amount of waste handled)
facility which has not been identified or described in a County
26 Solid Waste Management Plan (CoSWMP) must be approved or disapproved

by the County Board of Supervisors, and by a majority of the
1 Cities/Towns within the County which contain a majority of the
2 population of the incorporated area of the County, within ninety
3 (90) days after the site Identification and Description is submitted
4 to the city/Town or County. If the City/Town or County fails to
5 approve or disapprove of the site Identification and Description
6 within ninety (90) days, the city/Town or County shall be deemed to
7 have approved the site Identification and Description, as prepared
8 and submitted by the applicant; and
9 WHEREAS, the Mayor and Common Council of the city of San
10 Bernardino may not disapprove the proposed site Identification and
11 Description unless it determines, based upon substantial evidence in
12 the record, that there will be one or more significant adverse
13 impacts within the city's boundaries from the proposed project: and
14 WHEREAS, pursuant to the California Environmental Quality Act
15 (CEQA), a Mitigated Negative Declaration was adopted by the SBCo
16 SWMD/Planning Department and a Notice of Determination was filed
17 with the San Bernardino County Clerk of the Board on August 20,
18 1993, also subsequently filed at the Governor's Office of Planning
19 & Research on August 27, 1993; and
20 WHEREAS, the County Department of Environmental Health
21 Services/Local Enforcement Agency (LEA) Program, pursuant to CEQA,
22 is the Regulatory Responsible Agency for the project entrusted to
23 issue the SWF Permit with concurrence provided from the California
24 Integrated Waste Management Board (CIWMB); and
25 WHEREAS, provided that the conditions of the permit are
26 complied with, there is no substantial evidence in the record that

there will be one or more significant adverse impacts, (within the
1 City of San Bernardino boundaries) as determined by findings made by
2 the CEQA Lead Agency noted above, caused by the proposed project;
3 NOW, THEREFORE, BE IT RESOLVED that the Mayor and Common
4 Council of the city of San Bernardino, in the County of San
5 Bernardino, hereby approves the site Identification and Description
6 for the Mitsubishi Cememt Cushenbury Solid Waste Sanitary Landfill
7 Facility.

BIG BEAR (MT. DOBLE) SANITARY LANDFILL
PROJECT DESCRIPTION
Purpose
The San Bernardino County Solid Waste Management Department (County) is currently
in the process of revising the 1979 Solid Waste Facility Permit (SWFP) for the Big Bear
Sanitary Landfill. Revisions will update the existing permit to be consistent with current
operations and/or design of the facility and recent State-mandated operating
requirements.
Location
The Big Bear Sanitary Landfill is located within National Forest Land in an unincorporated
area of San Bernardino County (see Figure 1). The site is approximately 2 1/2 miles from
the City of Big Bear Lake and approximately 1 1/2 miles north of Baldwin Lake and State
Highway 18. Access to the landfill is provided oft State Highway 189 via Holcomb Valley
Road, a two-lane paved road.
Proiect Summary
The Big Bear Sanitary Landfill was permitted in 1979 as a Class II landfill; however, since
issuance of the 1979 SWFP, the classification for this type of waste disposal facility has
been redesignated Class III.
The landfill began operations in 1949 as a bum site and has since developed into two
separate disposal areas. The lower area consisted of a 10 acre disposal footprint and
began as a cut-and-cover landfill in 1972. Landfill operations at the lower site were
discontinued in 1987 and completed final closure in 1989. The upper area of the landfill
is presently operating and consists of an approximate 25 acre disposal footprint.
The 1979 SWFP identifies the permitted waste disposal area of the Big Bear Sanitary
Landfill as 58.6 acres. This acreage was based on the 1972 USFS Special Use Permit.
The 1991 Special Use Permit has been modified to allow for the use of 79 acres for solid
waste disposal activities. No change in the disposal footprint from that which presently
exists is requested under this SWFP Revision. The bulk of this additional acreage (20.4
acres) is located west of the active landfill adjacent to the access road traversing the site.
Presently, approximately 4.5 acres have already been disturbed by accessory landfill uses
(I.e.. access roads, drainage facilities, etc.). This Revision to the SWFP would allow for
the disturbance of an additional 3.5 acres south of the active landfill for the potential
establishment of a baling/recycling facility and approximately 9 acres west of the access
road for borrow area.

93-395 Table 1 summarizes the operational changes proposed in this permit revision by the San
Bernardino County Solid Waste Management Department. This change is, requested so
that the SWFP can accommodate and be consistent with existing operations and State
solid waste disposal requirements.
The potential establishment of a baling/recycling facility is being considered in response
to AB 939 waste diversion goals. The baling/recycling facility, if developed, will consist
of two large steel frame buildings. One building will be the recycling station (including
balers), and the other building will be a retail facility for recovered items.
Revision to the SWFP includes development of final grading plans which enable a more
precise estimate of future site capacity and site life of the landfill. The final grading plan
utilizes 2:1 final slopes and identifies ultimate height of the landfill as 7030 feet above
mean sea level.
The existing Big Bear Sanitary Landfill will be designed and operated in compliance with
all applicable local and state regulations. A Mitigated Negative Declaration was adopted
for the project and the Notice of Determination was filed with the Clerk of the Board of
Supervisors of San Bernardino County on July 24, 1992, in San Bernardino County and
with the Governor's Office of Planning and Research on July 30, 1992, pursuant to the
California Environmental Quality Act. An application for Revision to the Solid Waste
Facility Permit has been submitted to the San Bernardino County Department of
Environmental Health Services.
