BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is hereby
authorized and directed to execute on behalf of said City an
greement with the City of Fontana relating to animal care and
control services, a copy of which is attached hereto, marked
Exhibit "A" and incorporated herein by reference as fully as though
set forth at length.

(.) Fontana agrees to compenlllate San Bernardino for

Services, in the amount not to exceed $99,000.00 for the period of
AuqU.t 16, 1993 thruugh December 31, 1993. Fontana Ihall not ce
required to pay <\lny amount; in exceel5 of thie sum, whether for
oo~yin; ~08t8, incidental, direct or inQi~ect costs or any type
inourred by San 8ernardino.

ability of the partiee to amend this agreement to provide tor extra

(a) I!'onto.nll may withhold poyment of any disputed sums

Such withholding .hall not be deemed to constitute a failure to pay
as that term is u.ed in *ubparl9rAph 3(~), SAn Sernardino shall
not disoontinue its wo.k to~ a period of thirty (30) days from the
cSaU of withholding, as a result of luch withholding. Son
Sernordino .hall have ,i,l\lI\lediate right of appeal to the Mayor and
City Council of Fontana wi~h respect to Iluch disputed sums. 'rhe
detormination of the Mayor and Ci~y Council with respect to such
matter shall be final. San Bernardino .hall be entitled to

(7\) per annum from date of withholding ot any amounts found to
have been improperly withheld.

10. Warranty

11. Worker'. ComperHlation Il1llurance
San Bernardino .hall cover its employees with Workers'
comp'nea~ion inluranee and en.ure that the employees of any of its
.~boontr.ctorB are covered QY workers oompensat1on insurance in an
amount and form to me.~ all applicable requirements of the ~abor
cod. of the State o! California.
12. Prohibition Against Transfer.
(.) San Bernardino ahall not asaign, 8ublealle,
hypothecate, or tranllfer this Agreement or any interest therein
directly or indirectly, by operation of law or otherwi.e without
the prior written consent of Fontana. Any attempt to do 10 without
eald coneent Ahell be null and void, and any aaslgnee, .uble....,
hypothecate or transferee shall acquire no right or inte.est by
re..on of such attempted a.signment, hypothecation or transfer.
13. Anti-Dlscr~ination

the provisions of the California Politica~ Reform Act of 1~74 (the

interest that may foreseeably be materially affected by the work
performed under thie A9r.emen~, and (2) prohibita Such persons
from making or participatinq in making decilions that will
for....ably financially affect suoh interest.
(b) San Bernardino shall conform to all r&qui~.ment8 of
~he Act. P5ilu~e to do 10 constitutes a material breach and ia
grounds for termination of the Agr6ement ~y Fontana.

(4 1/2) monthe commencing ou August 1~, 1993/ and terminating on
December 31, 1993. The partiea may mutually agre. to extend the
contract on en interim basia if a new agreement is not reaChed by

The City of San lernardino will provide Animal Control and
Animal Welfan Services to the City of Fontana ("City") under the
exi.ting provisions of City Ordinances prescribing prOOedures and
Itand.rde for licensing, impounding, regulation and control of dogs
and other dom&6ltic and wild. animals ail stated in Chapter 5 and
Chapter 17, Section 3d. Further, the City of San Bernardino will
alsilt the City in drafting and implementation of new or revised
animal control ordinances as required by the City.

The term of the a;reement _hall be from August 16, 1993
through December 31, 1993. (See item number 11 for the iervices to
be provided during the period of August 15, 1993 throuqh August 31,
1993 . )

The City of San Bernardino will operate an animal control
pro~r.m !o~ the City consiatinq of the followinq three activities:

own Clerk of the court. All citation revenues
will be retained by tne City of SaIl lhlrnardino

Bernardino for adoption. Animals with

provide ~m.rg.ncy ce.ll-out. 'rho Cit:r of !'ontana will supply a
minimum of two (Z) hand-held radios and chargers for emergency
contacts to be kept at the San 8ernardlno Animal Shelter.

Monday through Friday, 10:00 a.m. - 5:00 p.m., and Saturday from
10:00 a.m. - 4:00 p.m. The .helter shall be closed Sundays and

information for Fontana residents.

fees in accordance with current city of San Bernardino resolutions.

follow up with RP for additional information. ACO will then notify
