HomeMy WebLinkAbout1994-356 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 RESOLUTION NO. 94 356 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, MAKING FINDINGS AND DETERMINATIONS AS TO THE BENEFIT TO THE VARIOUS REDEVELOPMENT PROJECT AREAS OF MAKING CERTAIN LEASE PAYMENTS ON BEHALF OF THE CITY OF SAN BERNARDINO (CITY HALL PROJECT) WHEREAS, the City of San Bernardino, California (the "City"), is a municipal corporation and a charter city duly created and existing pursuant to the Constitution and the laws of the State of California; and WHEREAS, the Community Development Commission of the City of San Bernardino (the "Commission") on behalf of the Redevelopment Agency of the City of San Bernardino (the "Agency"), is a redevelopment agency, a public body, corporate and politic of the State of California, organized and existing 16 pursuant to the Community Redevelopment Law (Part 1 of 17 Division 24 commencing with Section 33000) of the Health and 19 20 21 22 23 24 25 26 27 28 18 Safety Code of the State of California (the "Act"); and WHEREAS, pursuant to Section 33445 of the Act, the Agency may, with the consent of the Mayor and Common Council of the City (the "Council"), pay all or a part of the cost of installation and construction of any building, facility, structure or other improvement which is publicly owned either within or without the boundaries of a redevelopment project area if the Council determines: (1) that such buildings, facilities, structures or other improvements are of benefit to the redevelopment project area or the immediate neighborhood in which -1- I 94-356 1 the project is located, regardless of whether such improvement is 2 within another project area, or in the case of a project area in 3 which substantially all the land is publicly owned that the 4 improvement is of benefit to an adjacent project area of the 5 Agency, (2) that no other reasonable means of financing such 6 buildings, facilities, structures or other improvements is 7 available to the community, and such determination by the Agency 8 and the Council shall be final and conclusive, and (3) that the 9 payment of funds for the cost of the facilities, structures or 10 other improvements will assist in the elimination of one or more 11 blighting conditions inside the project; and 12 13 WHEREAS, the City and the Commission have previously 14 approved and adopted Redevelopment Plans (collectively 15 hereinafter referred to as the "Redevelopment Plans") for various 16 redevelopment project areas within the City which project areas 17 include: the Meadowbrook-Central City Project Area, Central City 18 North Project Area, Central City East Project Area, Central City 19 South Project Area, Central City West Project Area, Tri-Cities 20 proj ect Area, Southeast Industrial Park Redevelopment proj ect 21 Area, South Valle Project Area, State College Project Area, 22 Northwest Project Area and the Mt. Vernon Project Area; and 23 24 WHEREAS, it is in the interests of the present 25 landowners wi thin the various proj ect areas subj ect to the 26 Redevelopment Plans (the "Project Areas") and the residents, both 27 within the Project Areas and within the City generally, that the 28 Agency causes the funding of certain lease payments on behalf of -2- I 94-356 1 the City in order that the City be entitled to the continued 2 occupancy of the City Hall Building which is located within the 3 downtown central business district of the City; and 4 5 WHEREAS, the Project Areas presently suffer from a high 6 degree of impaired investments and depreciated values along with 7 high business vacancies which conditions are being exacerbated by 8 the lack of economic opportunities within the various Project 9 Areas; and 10 11 WHEREAS, the City, through its various departments 12 located at City Hall is continually attempting to create economic 13 activities and development within the various Project Areas and 14 the City generally and thereby eliminate blighting conditions 15 within such Project Areas; and 16 17 WHEREAS, City Hall and the City's various departments 18 located therein provide a full range of social and economic 19 services and opportunities to the community which services are 20 relied upon by residents and occupants of the Project Areas and 21 the City generally; and 22 23 WHEREAS, City Hall is located within a portion of the 24 central city area which suffers from a lack of business 25 opportunities as well as inadequate and deteriorating office 26 space facilities and which area is patronized by residents and 27 occupants of the proj ect Areas who pursue employment, seek 28 business opportunities and who rely on the provision of economic, -3- 94-356 1 social and civic services provided by governmental departments; 2 and 3 4 WHEREAS, the central city area suffers from high 5 vacancy rates and the continued occupancy by the City departments 6 within such area will help alleviate such vacancy rates both from 7 its own occupancy of office space as well as the occupancy of 8 nearby space by businesses and offices that typically congregate 9 in proximity to City Hall offices; and 10 11 WHEREAS, the payment of the City's lease obligation in 12 order to ensure the City's continued occupancy of City Hall in 13 the downtown area of the City, wherein residents of the Project 14 Areas and the City generally may avail themselves of economic 15 opportunities as well as civic and commercial services, will 16 provide a benefit for the Project Areas and the residents of the 17 adjacent neighborhoods who participate in activities or who are 18 employed in the downtown area; and 19 20 WHEREAS, in order to promote the City's health, safety 21 and welfare, it is important that the Agency fund the City's 22 lease obligations in order to ensure the orderly development of 23 the Project Areas and neighboring areas; and 24 25 WHEREAS, it is appropriate at this time for the Council 26 to make certain findings and determinations and take certain 27 action with respect to the Agency's funding of the City's lease 28 obligations. -4- 94-356 1 NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE 2 CITY OF SAN BERNARDINO, CALIFORNIA, DO HEREBY FIND, RESOLVE, 3 DETERMINE AND ORDER AS FOLLOWS: 4 5 Section 1. The Recitals hereinabove are true and 6 correct and are incorporated herein by this reference. 7 8 Section 2. The Council approves the payment by the 9 Agency of the costs of the City's lease obligations which is of 10 benefit to the Project Areas and other neighborhoods within the 11 City for the reasons set forth in the Recitals hereinabove. The 12 Council also finds and determines that no other reasonable means 13 of financing the City's lease payments is presently available to 14 the City and that the City and the Agency require the use of 15 revenues generated from the various Project Areas in order to 16 fund the City's lease payment obligations. The Agency further 17 finds that the payment of the City's lease obligations will 18 enhance the desirability of the City for economic investment 19 which in turn will enhance economic viability in the Project 20 Areas thereby eliminating existing blighting conditions in the 21 Project Areas. 22 23 Section 3. The Agency's payment of the City's lease 24 obligations in the downtown area will make the central business 25 district more economically viable through the reduction of 26 otherwise high vacancy rates and elimination of factors hindering 27 the economic viability of downtown buildings which will thereby 28 make the entire City and the proj ect Areas more desirable for -5- 94-356 1 development which will in turn help eliminate blight within the 2 Project Areas and other areas of the City. 3 4 Section 4. The findings and determinations herein shall be final and conclusive. This Resolution shall take effect upon the date of its adoption.
