Home My WebLink About1993-127 1 2 3 4 RESOLUTION NO. 93-127 A RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING TIlli REPORT OF THE DIRECTOR OF PUBLIC WORKSICITY ENGINEER FOR THE CONSTRUCTION OF CERTA I N lMPROVEMENTS TO VARIOUS PROPERTIES IN THE CITY OF SAN BERNARDINO, PLACING A LIEN THEREON, AND CONFIRMING THE 1993-94 ASSESSMENT ROLL. 5 WHEREAS, pursuant to the provisions of Chapter 27 ()f the Improvem('()l: 6 Act of 1911, and Chapter 12.92 of the San Bernardino Municipal Code, the 7 Milyor and Common Council of the City of San Bernardino did on the 11th day of 8 March, 1991, order the construction of certain improvements by prop'" ly 9 owners of various properties wi thin the City of San Bernardino, which 10 construction was to be commenced by January 25, 1991; and 11 12 13 14 15 16 17 WHEREAS, the said construction was not commenced by said date and the Director of Public WorkslCity Engineer caused said work to be done; ,'IHj WHEREAS, according to the provisions of said Chapter 27 and Chapter 12.92, a report has been filed by said Director of Public WorkslCity Engin, "t' specifying the work which was done, the cost of construction, a description of the real property in front of which the work was done and the assessml'lIlc 18 against each lot or parcel of land proposed to be assessed to pay the cost 19 thereof; 20 21 22 23 NOW THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO RESOLVE AS FOLLOWS: SECTION 1. That the Mayor and Common Council do hereby find and 24 determine that the costs to be levied against the parcels of land,s 25 delineated in the report by the Director of Public WorkslCity Engineer, 26 attached hereto as Exhibit "A" and incorporated herein by reference, are 27 III 28 III RES 93-127 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 correctly set forth and do hereby confirm said report and costs. SECTION 2. That the City of San Bernardino, acting through its Director of Public WorkslCity Engineer does hereby claim a lien on all of lllc properties listed in said report in the amounts so listed which are not paid within five (5) days from the date of this Resolution and the same shall b,' a lien upon said real property and collected with the annual property taxes over a period of three years until the said sums, with interest at the r.d C of 7% per annum on the unpaid balance, are paid in full. SECTION 3. That the assessment roll, designated as Exhibit "B" ""I attached hereto, representing the correct proportionate costs to be levied against the parcels of land as set forth thereon for 1993-94, is hen'lJY confirmed. SECTION 4. That pursuant to Section 5893 of the Streets and Highways Code of the State of California, the City Clerk is directed to cau,;c a copy of this Resolution and a list of the unpaid assessments for 1993-94 including interest, to be transmitted to the Office of the Auditor-Controll",. for the County of San Bernardino with the request that the individual assessments be placed on the subject property tax bills for collecti"n together with all other property taxes.
