HomeMy WebLinkAbout1993-118 RESOLUTION NO. 93-]] R 1 2 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ENDORSING THE CREATION OF A SERVICE AUTHORITY BY THE SAN 3 BERNARDINO COUNTY BOARD OF SUPERVISORS AND A MAJORITY OF THE CITIES IN THE COUNTY WITH A MAJORITY OF THE POPULATION TO PROVIDE FOR A ONE DOLLAR ($1. 00) VEHICLE REGISTRATION FEE TO BE USED FOR THE PURPOSE OF ABATING ABANDONED, JUNKED AND INOPERATIVE VEHICLES 5 WITHIN THE CITY, AND AUTHORIZING THE MAYOR TO EXECUTE DOCUMENTS PERTAINING TO THE SAME. 6 7 4 WHEREAS, in city of Bernardino the problem of the San abandoned, junk, and inoperative vehicles is a hazard and public 8 nuisance and has been recognized by the adoption of procedures for 9 their abatement; and 10 11 WHEREAS, by enacting Vehicle Code Section 22710, the State of recognized the problem by adopting California has similarly 12 procedures for the inclusion of an annual one dollar ($1) fee on 13 registered vehicles, to be returned to the counties and cities, for 14 15 abandoned vehicle abatement; and WHEREAS, any money so received shall be used only for 16 abatement, removal, and disposal as public nuisances of abandoned, 17 wrecked, dismantled or inoperative vehicles or parts thereof from 18 19 private or public property, and WHEREAS, the regulations and guidelines established by the 20 State require that a county-wide Abandoned Vehicle service 21 Authority ("Service Authority" herein) be established pursuant to 22 Section 22710 of the California Vehicle Code; and 23 24 25 WHEREAS, because of the delay in receipt of State guidelines for establishing an Abandoned Vehicle Service Authority, timeliness is of the essence in fulfilling the requirements of Vehicle Code 26 section 22710 and the regulations promulgated thereto. 27 / / / / / 28///// RES 93-118 1 NOW THEREFORE, the City Council of the City of San Bernardino 2 does hereby resolve as follows; 3 1. The city of San Bernardino supports the establishment of 4 the San Bernardino Abandoned Vehicle Service Authority. 5 2. That the Mayor of the city of San Bernardino is 6 authorized and directed to enter into all necessary contracts or 7 agreements with the San Bernardino County Service Authority on 8 behalf of the City Council, subject to City Attorney review and 9 approval. 10 3. That the staff of the San Bernardino Service Authority be 11 staff from existing city personnel positions. 12 4. That any money so received shall be used only for 13 abatement, removal, and disposal as pUblic nuisances of abandoned, 14 wrecked, dismantled, or inoperative vehicles or parts thereof from 15 private or public property. 16 5.
