RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
PREPARATION AND EXECUTION OF APPLICATIONS AND AGREEMENTS FOR SAN
BERNARDINO COUNTY COMMUNITY SERVICES FOOD DISTRIBUTION PROGRAM AT
MILL COMMUNITY CENTER.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The
Director of Parks, Recreation and
Community Services is hereby authorized and directed to prepare,
execute and submit an application and agreement for San Bernardino
9 County Community Services Food Distribution Program at Mill
10 Community center, a copy of which documents are attached hereto,

marked Exhibit "A" and incorporated herein by reference.
SECTION 2.
The authorization granted hereunder shall
expire and be void and of no further effect if the agreement is not
executed by both parties within 60 days following effective date of
the resolution.

Agreement For The Distribution of USDA Commodities
I. Distribution site (DS) agrees to define the specific geographical
area serviced to prevent duplication. Geographical aeea may be
defined by steeet boundaeies, zip codes, and/oe city served.
2. DS will insure that peopee stoeage will be provided foe dry, re-
frigeeated and feozen commodities as indicated on the containers
of each commodity until disteibuted and that commodities will be
disteibuted as soon as possible to ensuee geeatest possible fresh-
ness and palatability.
3. DS will insure that commodities peovided under this agreement will
be made available only to those eligible persons as defined by the
most recent eligiblity guidelines and in accordance with the distei-
but ion cates established by the State Depaetment of Social Seevices
(SDSS). (See Exhibit A).
4. DS will verify recipient income eligibility by eequesting to see
current evidence of eligibility in another public assistance peo-
gram (i.e., paycheck stubs, tax forms, etc.), or by self-ceetification
that recipient meets the income guidelines; and in all cases will
require each recipient to sign the eligibility certification foem.
(See Exibit B).
5. DS will insuee that USDA surplus food eeceived for distribution
shall not be sold, exchanged, bartered or transfered for money,
services, or other products.
6. DS will insuee that under no circumstances shall eecipients be re-
quieed to make any payments, in money, materials, or services for,
or in connection with the receipt of donated foods, noe shall volun-
tary conteibutions be solicited in connection with the receipt of
donated foods foe any puepose. Seevice will be on a first come,
first served bases and in a faie, equitable and nondiscriminating
manner.
7. DS understands and acknowleges that the disteibution of USDA sueplus
food commodities shall not be used foe political pueposes, and in
connection therewith specifically ageees that any commodities distei-
buted undee this agreement will not be wrapped or packaged in, oe
distributed with any material containing the names oe identification
of any individual elected official, candidate for office, or political
party.
8. DS agrees to peomptly investigate all reports of misuse of donated
food within their distribution area and to peovide pertinent infor-
mation to the San Bernardino County Food Bank.

9. DS agrees to keep an inventory of commodities showing. what is on
hand, received, distributed and/or returned to the EFO. A summary
report shall be submitted to the San Bernardino County Food Bank
by the 5th day immediately after a distribution detailing the number
of individuals served, the number of units of each commodity dis-
tributed and the number of units of each commodity remaining.
(See Exhibit C).
IO. DS by signing this agreement verifies that it is either a government
agency, or a private/public non-profit entity with tax-exempt status.
II. DS will not reallocate their food allotments to any other agency. If
the DS is unable to distribute the USDA food allocated, the San Ber-
nardino County Food Bank reserves the right to revoke the allocation
and redistribute the food.
12. DS agrees that all USDA distributions will be open and publicized for
all eligible recipients within the designated service area.
13. DS agrees to tranport USDA Commodities in vehicles and under con-
ditions that provide for safe vehicle operation and prevention of
spoliage.
14. DS agrees that no damaged or spoiled food shall be distributed. Any
such food must be returned to the San Bernardino County Food Bank.
15. The Agency agrees to indemnify, defend and hold harmless the County,
its agents, officers and employees from and against any and all lia-
bility, expense, including defense costs, legal fees and claims for
damage of any nature.
16. Upon approval of this agreement by the Community Services Department
it will continue year to year unless it is terminated by either
party. The DS or the San Bernardino County Food Bank may terminate
this agreement by giving thirty (30) days advance notice in writing
to the other party.
17. The San Bernardino County Food Bank reserves the right to monitor
DS distributions, as required by the State Department of Social
Services.
18. DS agrees to post fliers at strategic locations within the DS dis-
tributing area, e.g., supermarkets, post office, shopping malls,
bulletin boards, etc., or use a public service announcement to en-
sure that all eligible participants are advised of distribution
times and locations. The sites used for distributions must be
accessible to the general public.
19. Allocations of USDA Commodities for distribution will be based on
the number of households and persons served in previous distributions
by the DS. Additional commodities may be allocated (if available)
with a written request and justification submitted two (2) weeks
prior to a distribution.
