BERNARDINO AMENDING CLEAN UP DEPOSITS FOR PARK AND RECREATION EQUIPMENT AND STURGES BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Findinqs. The Mayor and Common Council hereby find: A. Hearing has been held by the Mayor and Common Council pursuant to the provisions of Government Code section 54990, et seq., to consider the levy of new and additional damage bonds and clean-up deposits for uses of certain Parks, Recreation and Communi ty Services Department buildings, facilities and equipment, which hearing was held following public notice published in a newspaper of general circulation in the City of San Bernardino. B. The proposed damage bonds and clean-up deposits are for the purpose of offsetting potential costs for repair or replacement of damaged equipment or facilities and for providing personnel services for clean-up of buildings or facilities. Bonds and deposits are refundable in full or in part after an inspection of building facilities and equipment has been completed. Deductions for any damages to facilities or for clean-up or repairs shall be deducted from said bond or deposit. C. The proposed damage bonds and clean-up deposits are reasonable and necessary to enable the City of San Bernardino to 3/2/93 -1- RES93-75 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RE: RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION 91-35 ADDING DAMAGE BONDS AND CLEAN-UP DEPOSITS TO MEET THE ACTUAL COSTS OF PROVIDING REPAIRS AND CLEAN-UP SERVICES AND FOR REPLACEMENT OR REPAIR OF DAMAGED EQUIPMENT AND FACILITIES. more nearly meet the actual costs of providing such services and facilities. SECTION Policv. Public parks and recreation 2. buildings and swimming pools, under the jurisdiction of the Parks, Recreation and community Services Department, are public property and as such are available for use by any person or persons in accordance with the following specifications and as deemed appropriate by the Director. SECTION Procedure. The facilities and equipment 3. shall be used only for those meetings and activities pursuant to city Municipal Code 12.80. Any person, persons, or groups of persons desiring the use of any facilities or equipment shall make application on forms provided by the Parks, Recreation and Community Services Department and shall provide such additional information as may be required to assure compliance with city Municipal Code 12.80. SECTION Cancellations: Cancellations of meetings 4. and activities may occur twenty-four (24) hours prior to scheduled use of facilities or equipment without forfeiting any fees and/or deposits collected by the Department. In the event of cancellation by the Department, notice will be given as far in advance of the scheduled use as is possible under the circumstances. 3/2/93 -2- RES93-77 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RE: RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION 91-35 ADDING DAMAGE BONDS AND CLEAN-UP DEPOSITS TO MEET THE ACTUAL COSTS OF PROVIDING REPAIRS AND CLEAN-UP SERVICES AND FOR REPLACEMENT OR REPAIR OF DAMAGED EQUIPMENT AND FACILITIES. SECTION 5. AMENDMENT. SECTION 6, Resolution 91-35, is amended by adding a damage bond and clean-up deposit schedule as follows: "SECTION 6. Refundable Damaqe Bonds and Clean-Up Deposits. A. Refundable damage bonds and clean-up deposits shall be required for all special events, athletic events, fundraisers and other events which warrant such bonds and deposits based on specific numbers of people and uses of facilities and equipment. Minimum bonds and deposits are as follows: Number of People Damaqe Bond Clean-Up Deposit Fewer than 50 $ 300 $ 75 50-100 $ 500 $ 150 101-200 $ 750 $ 300 201-500 $1,000 $ 750 501-1,000 $2,000 $1,500 1001+ $5,000 $3,000 B. Refundable deposits held pursuant to this resolution may be refunded in full or in part within fourteen (14) days after completion of the use period. No refund shall be made until the using party or group has secured a signed inspection and release form from the appropriate facility manager, and delivered this 3/2/93 -3- RES 93-75 1 RE: RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION 91-35 ADDING DAMAGE BONDS AND CLEAN-UP DEPOSITS TO 2 MEET THE ACTUAL COSTS OF PROVIDING REPAIRS AND CLEAN-UP SERVICES AND FOR REPLACEMENT OR REPAIR OF DAMAGED EQUIPMENT AND 3 FACILITIES. 4 5 executed release form to the Parks, Recreation and Communi ty Services Department.
