RESOLUTION NO. 93-64
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
4 BERNARDINO URGING THE RETENTION OF THE FEDERAL BANKRUPTCY
COURT IN THE CITY OF SAN BERNARDINO.
WHEREAS, the Federal Building which houses the Federal
Bankruptcy Court and is located at 699 North Arrowhead Avenue,
in the City of San Bernardino has approximately 72 employees
therein; and
WHEREAS, the surrounding offices of attorneys, trustees
and other related personnel provide approximately 100 to 125
jobs in the downtown area of San Bernardino; and
WHEREAS, the presence of the Bankruptcy Court in San
Bernardino has brought prestige to the City of San Bernardino
and has significantly added to the quality and competence of
the local bar and bench; and
WHEREAS, the present lease for the Bankruptcy Court in
San Bernardino expires in May of 1994 and the Bankruptcy Court
and appropriate federal agencies are considering alternative
sites for the location of the Bankruptcy Court, including a
site in the City of Riverside; and
WHEREAS, retaining the Federal Bankruptcy Court in the
City of San Bernardino is important to the economy of the City
of San Bernardino and will significantly contribute to and
provide further impetus for the Law and Justice Center of the
City of San Bernardino which can include the future site for
the new Federal District Court facility; and
WHEREAS, the City of San Bernardino recognizes that in

making a decision regarding the location of the Federal
Bankruptcy Court there are certain needs and specifications
that must be satisfied so that the Bankruptcy Court facility
will have adequate space, parking, securi ty and amenities
befitting a Federal Court; and
WHEREAS, the City of San Bernardino further recognizes
that effective communications with the local Bankruptcy
Judges, the Bankruptcy Clerk and other employees is necessary
so that their needs can be clearly identified for the purpose
of structuring proposals for retaining the Bankruptcy Court in
San Bernardino which can gain their support and approval; and
WHEREAS, the City of San Bernardino is in the process of
formulating a written proposal which will set forth three or
more potential sites for retaining the Bankruptcy Court in the
City of San Bernardino, one of which proposals will be the
Current location with improved parking, additional space and
improved security; and
WHEREAS, additional law enforcement presence in the
immediate area of the Bankruptcy Court will be made available
for the purpose of providing additional security to the
employees of the Court and the public who frequent the Court;
and
WHEREAS, the City of San Bernardino will also develop
additional programs and procedures for assuring the safety of
those persons who frequent the Court, revitalizing the area of
the community adjacent to the Court and assuring quick and
effective response to any incidences that arise at or near the

vicinity of the Court; and
WHEREAS, there is a strong and compelling basis for
retaining the Bankruptcy Court in the City of San Bernardino,
including the following: (i) the City of San Bernardino is the
most convenient location of the Court, taking into account the
number of bankruptcy filings in the San Bernardino County and
filings in the Palm SpringslBeaumontlBanning areas where
access to San Bernardino is more convenient than Riverside,
and (ii) there is larger growth expected in the next five to
six years in the City and County of San Bernardino as compared
to the City of Riverside and immediate areas.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
SECTION ONE: That by the Mayor and Common Council of the
city of San Bernardino, the City of San Bernardino and its
staff are directed to communicate with the local Bankruptcy
Judges and Bankruptcy Court Clerk to determine their needs and
specifications for retaining the Bankruptcy Court in San
Bernardino.
SECTION TWO: That the city of San Bernardino will use its
best efforts to provide a first class site and facilities for
the Bankruptcy Court to assure the continued and future
location of the Federal Bankruptcy Court in the City of San
Bernardino where said Court will meet the public needs in the
most economical, safe and convenient way.
SECTION THREE: That the city of San Bernardino will also
use its best efforts to formulate and develop a first class
site and facilities in the City of San Bernardino for the

future location of a federal District Court and other Federal
agencies which would be housed in a local Federal Building.
