HomeMy WebLinkAbout1994-330 , 1 2 3 4 5 6 7 8 9 10 11 RESOLUTION NO. 94-330 A RESOLUTION OF THE CITY OF SAN BERNARDINO FINDING AND DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE AMENDMENT OF BOUNDARIES OF ASSESSMENT DISTRICT NO, 981 BY EXPANDING THE BOUNDARIES THEREOF TO INCLUDE ADDITIONAL TERRITORY IN THE DISTRICT FOR THE MAINTENANCE OF LANDSCAPING IN THE AREA OF MERIDIAN AND RANDALL A VENUES; ORDERING THE AMENDMENT AND EXPANSION OF THE DISTRICT AND THAT THE SPECIAL ASSESSMENT, INVESTIGATION AND LIMITATION ACT OF 1931 SHALL NOT APPLY. WHEREAS, by Resolution No. 87-389 adopted November 2, 1987, the Mayor and Common Council of the City of San Bernardino created Assessment District No. 981 for the maintenance of landscaping in the area of Meridian and Randall Avenues; and WHEREAS, the Mayor and Common Council of the City of San Bernardino 12 have preliminarily found that the public interest, convenience, and 13 necessity require the amendment of the boundaries of Assessment District No. 14 981 by the expansion thereof to include additional territory; and 15 16 17 18 WHEREAS, the Mayor and Common Council of the City of San Bernardino have, on the 19th of September, 1994, passed and adopted Resolution No, 94-286 entitled: RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY DETERMINING 19 THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE AMENDMENT OF BOUNDARIES OF ASSESSMENT DISTRICT NO. 981 BY EXPANDING THE BOUNDARIES THEREOF TO INCLUDE 20 ADDITIONAL TERRITORY IN THE DISTRICT; DECLARING ITS INTENTION TO PROCEED TO ORDER THE AMENDMENT AND EXPANSION OF THE DISTRICT; AND WAIVING NOTICE AND 21 HEARING. 22 which said resolution indicated that the City elected to proceed without 23 Notice and Hearing pursuant to Section 12,90.040C(5) of the Municipal Code as 24 the request to expand the boundaries of the existing District represents 100% 25 of the property owners liable to be assessed for the said landscape 26 maintenance, 27 / / / 28 09-26-94 , 94-330 RESOLlTION EXPANDING BOlNDARIES AD 981 1 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 2 3 SECTION 1, That the public convenience and necessity require, and 4 the Mayor and Common Council of the City of San Bernardino hereby declares 5 that the publ ic interest, convenience, and necessity requires and hereby 6 orders, the amendment of the boundaries of Assessment District No, 981 by 7 expanding the boundaries thereof to include additional territory in the 8 district; the work described in said Resolution No, 94-286 to be done as 9 provided in said Resolution and that the Special Assessment, Investigation 10 and Limitation Act of 1931 shall not apply, 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 2. Reference hereby is made to said Resolution No. 94-286 for a description of the work, the extent of the assessment district, the financing alternatives and for further particulars.
