Home My WebLink About1994-135 1 2 RESOLUTION NO. 94-135 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE DIRECTOR 3 OF PARKS, RECREATION AND COMMUNITY SERVICES DEPARTMENT TO EXECUTE AN AGREEMENT WITH CATHOLIC CHARITIES, INC., DIOCESE OF SAN 4 BERNARDINO, TO PROVIDE SENIOR AIDES TO CITY WORK SITES. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 1. The Director of Parks, Recreation and Community Services Department of the City of San Bernardino is hereby authorized and directed to execute an agreement with the Catholic Charities, Inc., Diocese of San Bernardino, relating to the placement of senior aides at City work sites. A copy of said agreement is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2. The authorization granted hereunder shall expire and be void and of no further effect if the agreement is not executed by both parties and returned to the office of the City Clerk within sixty (60) days following the effective date of the resolution. N:SC Senior AIDES Progrcm Policy And Procedure Manual 105 105 SENIOR AIDES PROJECl'/fDST AGm:Y ~ , To canply wi th the requirenents of the National Council of Senior Citizens Senior AIDES Progrcm, operated under Title V of the Older 1roericans l\ct, this ~reement is voluntarily entered into by City of San Bernardino Parks, Recreation and Community Services Departm)nt hereinaft~r referrea to as the Host ~ency, and Catholic Charities Inc., Diocese of SIB 150 E. Olive St, Colton, CA 9232. a subcontractor of the National Council of Senior Citizens Senior AIDES progran, hereinafter referred to as the Sponsor Agen::y. The Host ~ency agrees to provide a safe and healthful ~rk site for each Senior Aide, to provide adequate orientation and traini!XJ necessary to perfoIlll assigned job duties in accordance with a written job description, to provide additional traini!XJ as opportunities occur, and, to the extent possible, to treat each Senior Aide as a regular member of the Host Agen::y staff. The Host ~ency agrees to consider each Senior Aide for regular enployment, either full-time or part-time, when vacancies occur in the Host ~ency staff or Iotlen new positions are created. The Host Agen::y understands that the maximum le!XJth of time that a Senior Aide may renain in the same job assigrment shall not exceed 24 months, except under limited circunstances which will be detemtined by the lCSC Senior AIDES Program. Moreover, the Host ~ency understands that the Sponsor Agen::y reserves the right, followi!XJ reasonable notice, to reassign any Senior Aide at any time that reassigment will increase the Senior Aide's opportunities for training or unsubsidized enployment, or will otherwise serve the best interests of the Senior Aide, or will better support the goals and objectives of the Senior AIDES Progran. The Host ~ency agrees that no other national Title V project sponsor will be provided a work site while this Agreement is in effect. The Itlst Jlqency agrees to abide by the hours and ~rk schedules mutually agreed to for each senior Aide and to provide properly prepared time sheets, periodic perfoIlllance eI1aluations, and other required docunents. In addition, the Host Agency agrees and understaOOs that each senior Aide will be required to attend periodic Senior AIDES Project meetings duri!XJ regular working hours. . N:SC Senior AIDES Progri!lll Policy And Procedure ~ual 105 105 SENIOR AIDES PROJ'ECl'/B:lST ~ AGUmmIT , The Itlst J\qency agrees that the job to l<l1ich the Senior Aide is assigned is an increase in employment opportunities; will not result in the displacement of =rently enplo}'ed IoOrkers or in a reduction in non- overtime hours of work, wages, or benefits; will not impair any existin; contract for service or result in the substitution of the wages of the Senior Aide for other funds in connection with work which otherwise would be performed; will not be a substitution for any existin; federally assisted job; an:1 will not be in a position which is the scrne as or substantially the same as that cx:cupied by any other person who is on lay-off. Further, the Host Ager:cy agrees that it will not discriminate against a Senior Aide on the grOllllds of race, color, religioo, sex, national origin, or han:1icap. 'Ihe Itlst J\qency agrees to provide doc:unentation of in-kind contributions, if specified in an accanpanyin; letter of agreanent. Further, it is understood by the Itlst J\qency and the Sponsor J\qency that any contributioo, whether cash or in-kirrl, by the Host Ager:cy is purely voluntary and is not a condition for the assigllllent of any Senior Aide. The Host lIgency certifies by this Agreanent that it is a govemnental agency or is a non-profit agency Iotlich is =rently certified as a Section SOl(c) (3) organization under the Internal Revenue Code. :rurther, if the Itlst J\qency is certified as a Section 501 (c) (3) agency, a copy of that certification is attached or is on file with the Sponsor lIger:cy and is still in effect. 'Ihe Itlst J\qer:cy agrees to inform the Sponsor lIgency imnediately if the Section 501 (c) (3) certification is chan;ed. 'Ihe Sponsor J\qer:cy agrees to recruit, enroll, and assign a Senior Aide or Senior Aides to the Host lIger:cy for the purpose of en;aging in productive canmunity service anployment with duties and tasks as specified in a written job description. 'Ihe Sponsor J\qer:cy agrees to be responsible for all administrative and fiscal controls of the Senior AmES project and for payin; wages and providin; frin;e benefits to each Senior Aide.
